WHAT IS JUSTICE?

 

There is a tendency, in the media reporting of crimes, to mix up retribution with justice.

In my view, the punishment of the criminal should be designed to deter  crime or prevent future crime .It should not  be designed to fulfil an emotional wish for retribution or revenge.

These considerations should apply to crimes committed against peoples and nations and to relations between states.

Nations have a responsibility to defend themselves, and to help build a credible international order that will deter future crimes against peoples and states. Revenge and retribution should never guide relations between states.

Hamas has made a callous calculation. They reckoned that the  Israeli response would be so harsh as to strengthen Hamas’ position in Arab public opinion.

Unfortunately, Israel looks as if it is playing the role Hamas cast for them.

Is there another way to build a structure of peace?

First we need to think our way to a practical compromise between Israelis and Palestinians

 

TWO REQUIREMENTS FOR A TWO STATE SOLUTION

The international community advocates a “two state “ solution. It is far too easy to advocate two states within the territory of Palestine, without thinking through the practicalities.

"Two states" will not be a formula for  peace, unless

1.)     the  boundaries between the  two states are delineated,  and

2.)      there is a clear statement of the obligation each state would have towards the other, and the means whereby  these obligations might be enforced are set out in detail.

These  two issues should be put the every advocate of a two state “solution” by media interviewers. The answer given may not be definitive , but we would then be moving the debate away from evasive cliches, and towards difficult practical issues that cannot be avoided in the real world.

This is urgent because , if a two state solution cannot be found, we will be left with three ,even more difficult, options…..

   a one state solution,

   perpetual war, or

   complete defeat of one side or the other.

 

 

 

 

 

 

 

 

 

John, there is no border dispute of any kind between Israel and Gaza. Israel pulled out entirely in 2005. Instead of building a state, Hamas focused entirely on murdering Jews. That's the difference between civilisation and barbarism. What you falsely call retribution is existential self-defence, by the most moral army that has ever existed. It is tragic that Ireland is always so reflexively anti-Israel. Jews have been defenceless for millennia but today we say Never Again and mean it. Even if Ireland, the only country in Europe to send condolences to Germany upon the death of Hitler, never stands with us. I am available to discuss the situation with you.

The generic root cause of the conflict is divergence or growing apart instead of convergence or growing together. Whether people like it or not, any conflict continues until there is truce, regardless of the amount of atrocities committed by both sides. First after such truce is reached, the real peace building process can start. There are only two scenarios to sustainably end a conflict: -1- a “final solution” or total defeat of one of the two parties, leaving no-one behind to reignite the conflict in decades from now (God beware us!) -2- truce, followed by working on the root-causes in order to grow sustainable understanding for each other and establish convergence. If such convergence is established, the "wrong" divergent type of leaders will lose their control and a two state solution may not be necessary. Very good analysis John Bruton - The conflict in the Middle East is complex and deep rooted. The international community (especially the UN & EU & US) need to broker a ceasefire immediately and map out negotiations for a peace settlement.
