A Study Group appointed by the Japanese Ministry of Economy, Trade and Industry has recently published Guidelines on Fair Value Calculation of Standard Essential Patents for Multi-Component Products. The Group was composed of high-profile Japanese lawyers and academics.
The guidelines represent an important intervention into the ongoing debate concerning the tension between standard essential patents (SEPs) (which offer their owners R&D incentives/rewards in the form of monopolistic rights) and technology standards (which should be widely used by all players in the market to ensure interoperability).
About the Speakers
KODACHI Yoshiaki is the Senior Director for Intellectual Property of the Japan External Trade Organization (JETRO) Düsseldorf. He is engaged in supporting IP activities for Japanese companies in Europe. He has also served as a representative for the Japan Patent Office (JPO) in Europe since June 2018. He joined the JPO in 1999 as a patent examiner in the field of electronic commerce technology. Since 2010, he had been involved in several international cooperation projects among IP Offices at the JPO
Professor Enrico Bonadio is Reader at The City Law School, where he teaches various modules on intellectual property (IP) law. He holds law degrees from the University of Florence (PHD) and the University of Pisa (LLB), and is Associate Editor and Intellectual Property Correspondent of the European Journal of Risk Regulation as well as a member of the Editorial Board of NUART Journal.
Professor Luke McDonagh joined the Law Department of the London School of Economics in 2020 following a Senior Lecturer in the Law School at City, University of London. He undertakes research primarily in the areas of Intellectual Property Law and Constitutional Law. For 2017-18 he was a Visiting Lecturer at Keio University, Tokyo and a Visiting Scholar at Waseda University, Tokyo. For 2018-19 he was a Visiting Fellow at Toyo University, Tokyo.
