Moving from the UK to the UAE

Moving from the UK to the UAE

The UK Autumn 2024 Budget includes significant changes to Inheritance Tax, Employers' National Insurance, Tax Bands, Capital Gains Tax, Business Owners Tax, Stamp Duty increases, and Domicile/Non-Dom status updates.

With the UK government increasing the tax burden in several areas, many UK residents/citizens and UK-based businesses and Business Owners are looking at more favourable tax jurisdictions like the UAE.

What are some of the major changes:

  • Capital Gains Tax increases from 20% to 24%
  • Employer National Insurance increases from 13% to 15% and the nil band drops from £9,000 to £5,000 per annum
  • Business Asset Tax increases from 10% to 18% and the lifetime limit is reduced from £10 million down to £1 million
  • Inheritance Tax will now be based on residency meaning foreign nationals living in the UK are subject to UK tax on their worldwide assets
  • Agricultural Property Relief lifetime limit introduced at £1 million giving an effective IHT rate of 20% for farmland
  • The Inheritance Tax (IHT) band frozen at £325K so it will effectively fall with inflation
  • Stamp Duty surcharge on second homes increases from 3% to 5% on properties over £500K
  • Flat rate Stamp Duty increases from 15% to 17%

Practicalities of moving from the UK to the UAE:

  • Residing in the UAE for over 180 days (6 months) will enable the individual to be eligible to obtain a UAE Tax Residency Certificate(TRC).
  • The individual should be in the UK no for more than 90 days in a year or they may be considered a UK tax resident.
  • A legal entity in the UAE must be established for a minimum of 1 year and obtain a financial audit in order to obtain a Company Tax Residency Certificate in the UAE.
