Ratification of the [phase 1] WTO Fisheries Subsidies Agreement by the landlocked developing countries: some thoughts on the reasons and implications
This mini-blog post sheds light on [some of] the implications of joining the Fisheries Subsidies Agreement (2022) (hereinafter FSA) for the landlocked developing countries (LLDCs), which are WTO Members. It also discusses reasons which might justify the ratification of this newest WTO covered agreement.
Status quo of the FSA ratifications (as of 06.02.2024)
Ratifications needed for the Fisheries Subsidies Agreement (FSA)[1] to enter into force: 110
Current ratifications: 56 (incl. the EU and its Member states)[2]
Out of those landlocked countries: 7 – Switzerland, Botswana (the only LLDC so far), as well as 5 EU Landlocked Member States: (CZ) Czechia, (LU) Luxembourg , (HU) Hungary, (AT) Austria and (SK) Slovakia.
Potential Influence of the “phase one” FSA on LLDCs
The “first phase” FSA, 2022, establishes disciplines related to subsidizing Illegal, Unreported, Unregulated fishing (IUU), fishing on overfished stocks, and fishing on high seas. It omits the core discipline of overcapacity and overfishing, subject to the ongoing negotiations under the so-called “future agenda”.
The FSA is concerned with marine wild capture fishing and fishing related activities at sea[3], and mainly imposes obligations on the 4 types of states: coastal states, flag states, port states, other states granting fisheries subsidies (for instance, to operators of fishing vessels registered or operating from their territories). Only the latter two categories could be relevant to LLDCs, as they could have marine fishing vessels under its flag or vessel operators[4] under its jurisdiction.
Nevertheless, some of the FSA obligations are cross-cutting and apply to all the WTO Members, even those not belonging to the 4 types of states identified above. It might have been reasonable to expect that these obligations would not necessarily apply to LLDCs. At the end, why to notify something that does not exist, or is present on de-minimis level. But, since the LLDCs did not engage in the negotiations, no related exemptions followed.
Among such obligations are the following:
Art. 3.7 (Subsidies to IUU Fishing) Each Member shall have laws, regulations and/or administrative procedures in place to ensure that subsidies referred to in Article 3.1, including such subsidies existing at the entry into force of this Agreement, are not granted or maintained.
Art.8 (Varied subs) Transparency / Notifications
Thus, despite being landlocked and not having / having limited maritime fishing fleet, should an LLDC ratify the FSA and when the latter would enter into force, it would need to adopt legal regulation of the IUU in line with the requirements of Art. 3 of the WTO FSA and initially and, next, regularly notify the WTO of the type or kind of fishing activity for which the subsidy is provided (if any)[5]; a list of vessels and operators that it has affirmatively determined as having been engaged in IUU fishing[6]. Within a year of entry into force of the FSA, its parties would also need to notify the WTO of the measures taken to implement the fisheries subsidies prohibitions[7], its relevant legal regime[8], and the Regional Fisheries Organizations / Arrangements (RFMO/As) in which it participates[9], if any.
Art. 7 of the FSA provides for creation of the WTO voluntary funding mechanism, assisting WTO developing countries, including LDCs, in the implementation of the FSA. Such mechanism was already established[10]. Ratification of the FSA (and a dedicated request) seem to be preconditions for the technical assistance from this fund, which WTO Members, landlocked or not, could seek / obtain.
So… why ratify the FSA (in particular, if LLDC)
· Out of support to the Multilateral Trading System;
· Out of support to Sustainability (taken broadly) or Sustainability of the oceans (taken more narrowly);
· Out of support to SDGs, notably SDG 14.6[11];

· Out of support to particular approaches embedded into the Agreement, for instance with respect to SDT; [NB: The SDT solutions in the first phase FSA are rather modest].
· Out of support to the position adopted by a particular group (regional, in the negotiations, etc.);
· Proactively thinking that similar rules could be elaborated for inland fishing. [The progress with the fisheries subsidies and the overall dynamics of the WTO suggests that this is unlikely in the near future at the multilateral level. Regional developments might be somewhat more likely];
· In case of availability of fishing fleet flagged to LLDC, or operators of fishing vessels established or controlled from it;
· To get assistance from the FSA funding mechanism to ensure legal compliance with the FSA requirements (a circular argument).
In any case, it is important to communicate the reasons underpinning the ratification to make it most effective. They might be multiple / combined.
The Ratification “Momentum”
Ratification “Momentum” is also crucial / has to be chosen wisely to attract sufficient attention / “deliver” otherwise, including in a short-term perspective.
