REASONS for Siamak Khajehpour’s resignation from Metrolinx (GO Transit) in 2013.

This afternoon I have received an email from my lawyer. The email contained threats of another prosecution by Metrolinx.
Due to the threat, see below in Italic, I badly scared, so much that I was shivering like a person hit with an super arctic air from a super nova on the other side of the Atlantic Pond, at 0 degree Kelvin 0r Absolute Zero which is -273.15 °C.

“………I am writing with respect to your client Veresk Inc. (“Veresk”). Please note that Melissa Serpe is no longer with Metrolinx and her file concerning Veresk’s dispute with Metrolinx has recently been transferred to me.
I am writing you today because this morning it was brought to my attention that Veresk’s principal, Mr. Siamak Khajepour, posted unsolicited and unwanted LinkedIn messages to various members of Metrolinx’s Senior Management Team including about matters that may be related to the dispute(s). I attach screenshots of those messages here for your review.
May I kindly request that you ask your client to refrain from contacting anyone from Metrolinx directly either for matters that are being addressed by counsel or that could be seen as harassment etc.

The reason for receiving the above email was that I, Siamak Khajeh[pour, placed three comments on Metrolinx’ bosses, 2 comments on Mr. Phil Verster’s posts (CEO of Metrolinx) , and one-comment on Chief Engineer’s posting:

I, Siamak Khajehpour, reviewed, on behalf of Capital Infrastructure Department of GO Transit/ Metrolinx, this +/- 3000m long elevated bridge known as UP, AirLink, UP Express in 2012, 2013; when I was an employee of Metrolinx for only less than +/-4 months. The cost of the UP Express was around 900M$ to 1B$, including four Stations, track, signal and +/+3km elevated bridge. The emails related to this review were....lost. In less than 2 years after the grand opening of the project, all sort of issues popped up; ie cracks, displaced elastomeric bearings, sheared off bolts, broken, cracked, deteriorated plints.
It was a 3P (Public, Private, Partnership) project.
Every single organization in this project Sued each other, i.e. owner against contractor, contractor against its own partner being the consultant, Consultant against its own partner being the contractor,......... Now, by this plan, as shown on the poster above, ( See Yellow Line) +/-1B$ already constructed project goes to drain? Really? What a great decision, what a superior Leadership, fantabulous project managerial skill !!! You guys, at Metrolinx, are really and True Leaders. Bravo Metrolinx, Bravo!!!!

I always heard good things about you, comments about you always included words such as " [REMOVED]*** is a person of high dignity, integrity, professionalism, knowledge, .....". However as a Chief Engineer of Metrolinx you are responsible to ensure the Safety of the commuter trains and people riding it maintained. I have sent letters to you and your organization, Metrolinx CEO, via my lawyer to Damian Hornich/MX, to bring up Metrolinx's attention about the shortcomings, neglect, incompetency and perhaps illegal actions of people serving under your supervision at one of your departments, by then named as, Rail Corridor, currently runs under different name, at address +/-335 Judson Ave., Etobicoke, west of Islington. Metrolinx conveniently did not take necessary actions to correct the situation. Unfortunately in the eyes of law, you might, most probably, be known as responsible, if any failure at any of Metrolinx structures, (due to neglect, incompetency, or other silly excuses....), happens. The problem is, when I scared, I write.
If I scare more, I write more.
And since I am very badly sacred from Damian Hornich/Metrolinx (Counsel , Lawyer, Director) email to my lawyer, I am releasing the blow statement which explains the reasons that I left Metrolinx. The last day of my work at Metrolinx as an employee was around March 12 or 13, of 2013.

Hello [REMOVED],
I am writing this email to you to shed light on various reasons that led me to decide to start looking for a job with another employer outside of GO Transit, either consultants or railways.
Also, it is my intension to send this email - after discussing it with you face to face - to GO Transit Human Resources, however, I will not send it to GO HR prior to our face to face meeting tomorrow.
As discussed in various occasions, the following are my reasons to decide to start looking for another company/ organization and leave from GO Transit.
A) Issues with [REMOVED], Manager of Civil Infrastructures,
A1- Mr. [REMOVED] ordered / required me - Siamak - to close my eyes to various structural issues in ARL (Air Port Link) project. As I was requested / required by Mr. [REMOVED] - due to your direct recommendation - to look into the mentioned project and provide comments.
Many of my comments were regarding structural deficiency of the designed and partly constructed ARL bridge, that could potentially catastrophic and might have result to; a) potential derailment of trains on elevated bridge, b) potential partial collapse of the elevated bridge, and C) potential injuries or worst, unnecessary loss of innocent lives of people riding ARL commuter trains.
I have provided part of my comments to Mr. [REMOVED] and you, in your office.
Mr. [REMOVED] – after hearing my comments - got upset, stood up, and told Siamak that "...we gave you this project to look at the drainage of its deck and tell us this is a 100 year Service Bridge. Instead you looked at spec, design calculations, drawings, and telling me this project is unsafe?"
In another occasion, in response to more detailed comments, Mr. [REMOVED] stated to Siamak that " ...Now, you want to demolish the whole constructed bridge?....."
I. Siamak, responded to Mr. [REMOVED] that all of these issues are serious structural deficiency and must be properly addressed; however, we do not need to demolish the whole bridge.
Also, I, Siamak, told Mr. [REMOVED] that there is no construction project without any challenge(s); and ARL is not an exception either.
After many times discussion and constant Mr. [REMOVED] suggestions to me – Seamark - to look away from the structural deficiency of ARL, in response;
I, Siamak, took few coins from my pocket, placed it on Mr. [REMOVED]’s desk and stated to Mr. [REMOVED] that : “- I, Siamak, worked for [REMOVED] Rail for around 8 years, a pure private company, that works only for these while I, Siamak, was pointing to those coins – stated to Mr. [REMOVED] that at no time, no one at [REMOVED] ever told/requested or required me to close my eyes to any structural problem.”
As you aware, the above conversation has been discussed in your presence at Mr. [REMOVED] 's office.
A2) Spur line , Expect at Kingston 304.28, South Blair Mr. [REMOVED] ordered me more than 5 five times to force [the consultant] [REMOVED], to design a spur track leading to Exopack with more than 25 degrees of Curve. These discussions often happened in front of coordinator of the above project.
I, Siamak, in response stated to Mr. [REMOVED] the following:
· -According to [REMOVED] ex-track supervisor of this area, there have been various derailments of trains on the existing Exopac spur line, and
· -A track with +/-25 degree of curve immediately off a bridge is extremely dangerous.
· -There is no guarantee that a train stays on the bridge, and not fall down on in coming traffic South Blair road below, in case of derailment.
A3) Hagerman bridges, UxBridge & York , UxBridge & 14th Ave Mr. [REMOVED] ordered me to pass these two projects to GO Maintenance group, despite various reasoning of I, Siamak to [REMOVED], and explain to him that passing a bad pack to our teammates, does not resolve the problem. And both of these bridges have serious issues that must be addressed.
Based on above explained conversations, I have doubt that Mr. [REMOVED] has properly appreciated the gravity of the issues explained above. This led me to believe that, Mr. [REMOVED] does not care for Public Safety!!!
B) Past behavior of GO Transit, and its agents, As I have discussed this issue with you, I, Siamak Khajehpour subjected to many threats, harassment, foul language, intimidations, and property damage, by GO Transit contractor, GO Transit consultant, GO Transit sub consultant to GO Transit contractors, between 2005 till 2009.
Below please find list of few examples - but not limited to - of these criminal acts;
· [REMOVED]: Union Station, Oakville 0.1, 25 York street, TELUS building, adjacent to ACC.
· [REMOVED]: Oakville 0.11, 18 York Street, building on west side of York at ACC.
· [REMOVED]: Halton 18.2 Mount Pleasant GO Station
All above issues have been recorded through emails at the time the crime(s) was/were committed.
At all above incidents, the problem(s) was/ were unsafe and potentially dangerous design and construction of shoring walls, and bridges along [REMOVED] Track, by GO Transit consultant and GO contractors.
Before joining GO Transit on Oct/22/2013, I, mistakenly, assumed that the above criminal actions were taken by GO consultants, or GO contractor, who wish to make more money and my rejection of their proposed or under construction or already constructed shoring walls and bridges, caused these contractors, consultants’ grief and loss of money. Also, I mistakenly assumed that grief and financial losses of these GO consultants, or GO contractors led them to commit these crimes.
However, after joining GO Transit, I have concluded that the above criminal acts were direct or indirect results of GO Transit general policy to give the ultimate authority to its contractors, in a fashion that even Middle East dictators did never enjoy, i.e., Design/Build contracts, PPP contracts, etc.
C) Culture of work at GO Transit I personally witnesses and subjected to the followings,
· Cheap and very dirty office politic
· Common and very well accepted back-stabbing among GO Transit employees, including Mr. [REMOVED].
· Blaming junior employees for mistakes that were not their fault at all.
· Etc, etc, etc
Due to above reasons, I have come to this conclusion that GO Transit is not an appropriate, decent place for me to work for, and could potentially extremely dangerous for me.
At the end, I would like to thank you for the opportunity that you have given me to work in your team at GO Transit. However, it does not work for me.
On a personal note, I sincerely believe that none of above issues is due to management style of Civil Infrastructure group, but due to personality, and lack of technical and professional qualifications for few people at GO Transit.
And, as always stated in front or in your absence, I do believe that the name of Mr. [REMOVED] is written with Dignity, Integrity and Decency.
An old expression states that "with one flower the winter never turn to spring". Flower denotes: [REMOVED] Winter denotes: GO Transit as its current condition Spring denotes: GO Transit as a proper place
