1. POSH - Prevention of Sexual Harassment: The comprehensive Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act, 2013.

2. Complainant - The brave soul lodging the complaint.

3. Respondent - The individual under scrutiny following a complaint.

4. Witness - A person providing fresh evidence or backing up facts during an investigation.

5. Internal Committee - The squad under the POSH Act, ensuring compliance, investigating cases, and making recommendations.


Unpacking the Fundamentals

1) Which complaint will be considered false/malicious?

   - A complaint where there is irrefutable proof of malicious intent, like tampering with evidence.

2) Does not having enough proof to prove sexual harassment count as false?

   - Absolutely not! Lack of evidence doesn't equate to a false or malicious complaint. You can raise concerns even without concrete proof.

3) What happens if a false complaint is made?

   - When there is clear proof that a complaint is false, the Internal Committee has the authority to penalize the complainant. The penalty aligns with the severity of penalties for genuine complaints.

4) Anything else?

   - Absolutely! If a witness in the investigation attempts to falsify evidence (not the complainant), the Internal Committee has the power to penalize the witness as well.
