Some Media People Seems To Be Confused About Intellectual Property!

While checking the latest happenings today, I stumbled upon this title ‘Taylor Swift trying to patent ‘1989’, title of her novel” of an article shared on the website of Indian Express.

The title jabbed my thoughts, why? You can decide yourself after checking the basic definition of trademark, patent and copyright which is given by USPTO itself.

A trademark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of the goods of one party from those of others. A service mark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of a service rather than goods. Think brand names, slogans, and logos. The term "trademark" is often used to refer to both trademarks and service marks.

A patent is a limited duration property right relating to an invention, granted by the United States Patent and Trademark Office in exchange for public disclosure of the invention. Patentable materials include machines, manufactured articles, industrial processes, and chemical compositions.

A copyright protects works of authorship that have been tangibly expressed in a physical form. Think songs, books, movies, and works of art.

When my inquisitiveness led me to the details, see what I got –

To my utter belief, media is just confused about the concept of patents, trademarks and copyrights. May be this post will help people to understand the news better.

True Nitin. There is a wealth of information on IP that they would have easily cross verified the information.

Great post sir, these things also pinpoint that journalists are too lazy to get their facts correct.

Nice point raised @ Shikhar Sahni Media people intermix everything (Trademark, Patent , Copyright) and hence create negative vibe about IP.
