AI Gets Legislated
Governments globally are deliberating new laws that will define the future of AI regulation. Trying to carefully balance the culture of open-source innovation, with regulations to ensure public safety. Leading the way in legislation currently are California’s AI Safety Bill and the EU AI Act. But what is the potential impact of these two acts and how will they shape the future of AI regulation?
Both the EU AI Act and the California AI Safety Bill look to ensure: stricter testing regulations, high standards for AI-generated imagery, and protect end-user privacy. But amongst all the legal points being discussed, there is one point that keeps coming up; What is open-source AI and how should its use be viewed?
The recent California Bill goes beyond the EU Act (which has its focus on regulatory stitches) and would pin more responsibility for the large language models that cost more than $100 million to the larger companies that create them and require them to undergo third-party audits.
Some large tech firms have argued against this stating it would make them liable for the use (or misuse) of models downstream by users they can’t control. Additionally, some open-source developers have argued the bill would effectively take away control from smaller developers due to the bill's “emergency shutdown” clause.
Proponents of the bill have argued that guide rails are long overdue and the bill aims to shoulder the burden of AI-model management on the larger companies that can afford the cost and have the tools to provide thorough oversight.
One thing no one is disputing, is that the new California Bill addresses the need for thorough testing in AI software development, by requiring regular third-party audits, stricter testing, and oversight. Something we at TestDevLab can get behind.
How CrowdStrike’s Outage Changed Microsoft’s Approach To Security Solutions
In July a seemingly normal Windows update ended up freezing the world overnight thanks to a CrowdStrike outage leading to blue screens globally.
In the months since Microsoft has started to re-evaluate how it manages its security solutions. Calling a meeting at its headquarters in Redmond, Washington attended by security vendors and government officials from the US and EU. Microsoft discussed various strategies aimed at long-term resilience in the endpoint security ecosystem.
One point on the table was expanding vendors’ ability to operate outside Microsoft’s Windows Kernel, to make it less likely that a faulty update would trigger widespread Blue screens of death. This however, has been met with fears that Microsoft will start restricting access to its kernel for security vendors in the long run, as something similar did happen in the past when Microsoft tried to restrict security access to Windows Vista in 2006 with a feature called PatchGuard.

In the immediate short term vendors at the conference agreed to greater transparency in information sharing to protect end users.
You can be sure that other companies will be taking notes from Microsoft so they don’t encounter similar mishaps in the future. This whole situation also highlights the importance of rigorous software and security testing before products are released, testing that is best done with experienced partners.

Crowdsource wasn't the only topic talked about at Microsoft’s HQ in Redmond this month. The issues facing current and future AI infrastructure were also discussed. At the event, the goal was set to make significant investments into the infrastructure needed to support the global drive to develop more powerful AI solutions.
With that goal in mind, BlackRock, Global Infrastructure Partners (GIP), Microsoft, and MGX will partner to mobilize up to $100 Billion to develop data centers and power infrastructure in order to provide open architecture and a broad ecosystem, on a non-exclusive basis, for AI to grow in.
These investments further cement the role of AI in the future of tech, and will likely signal an era where many of the digital services we use daily are AI-supported. Moving forward this will mean companies will need to invest significantly in AI quality assurance testing to ensure these products meet customer expectations and avoid serious issues.
