Two Post Witt O'Brien's Workshop Highlights: Updated WOTUS and New Haz. Sub. WCD Rules
If you missed Witt O'Brien's' two-day annual compliance workshop this past week, there were a lot of great questions asked of our presenters and a lot of great information presented by our three Presenters: Mark W. Howard , Troy Swackhammer , and Chris Perry. Over the next several weeks, I'll address some of the audience questions and the presenters' responses. This week, however, as last week was very hectic, I'll share two of the presentations on two hot topics.
The first one is on WOTUS (Waters of the United States). If you weren't aware, the new WOTUS definitions went into effect on September 8th, 2023. I will not summarize this here today; however, I will provide a copy of Troy's presentation and a link to the new rule.
The second topic I'll share today is the new Clean Water Act (CWA) Hazardous Substance Worst Case Discahrte Planning rule set to come out next year. The final rule has yet to be published; however, below is the summary the Environmental Protection Agency is sharing. If not familiar with this rule, it will similarly regulate CWA-regulated substances to oil under the Oil Pollution Act of 1990 (OPA90). The final rule has yet to be published, so a complete summary of what is required is unavailable now.
