(Un) Ease of doing business in India

So, India jumped 14 places on the World bank’s ease of doing business index to take 63rd position. While the jump is worth celebrating, however, we still have a long way to go. I often wonder how someone goes about doing business in the country, where to start, what rules to follow, what registrations to do, what are the regulatory filings to do. Beyond just paying taxes, there are a plethora of rules and regulations that almost no one is aware of. Not even our auditors or advisors!

 We’re currently in talks with a customer who wanted to audit our compliance before doing the business. They’ve given us the following checklist.

  1. Acts to comply – 8
  2. Physical Notices to display in our office – 14
  3. Submission to authorities – 8
  4. Maintaining various physical registers – 16
  5. Oldest act – 1936

 List of acts to comply – Shops & Establishment Act, Contract Labour (R&A) Act, Payment of Gratuity Act, EPF & MP Act, ESIC Act, Professional Tax, Labour Welfare Fund, Employment Exchange (CNV) Act

 Display of Abstracts & Notices – Registration Copy under Shops & Establishment  Act displayed, Abstracts of Contract Labour (R&A) Act, 1970 in Regional Language & English, Abstracts of Minimum Wages Act, 1948 in Regional Language & English, Abstracts of Payment of Wages Act,1936 in Regional Language & English, Abstracts of Maternity Benefit Act,1961 in Regional Language & English, Abstracts of Payment of Bonus Act in Regional Language & English, Abstracts of Gratuity Act, 1972 in Regional Language & English, Abstracts of Employees Compensation Act in Regional Language & English, Abstracts of Equal Remuneration Act in Regional Language & English, Abstract of Sexual Harassment Committee under Vishaka Judgment, Notices required to be displayed at work site, under Minimum Wages Act, showing rates of wages, hours of work, wage periods, date of payment of unpaid wages, Name and addresses of the inspector in English, Hindi and in a local language, Name Board-Name Board in Regional Language & English / Hindi, Holiday List, Payment Of Gratuity - Notice showing the name of the Authorized person to receive Notices under Payment

 Interestingly enough, the independent auditor assigned by the customer was not interested in knowing if we pay our taxes or do regular filings at the Ministry of Corporate affairs.  I’m certain that no one understands the above rules neither they understand if the above should be applicable to us.

 “The Indian IT industry grew to $181 Billion in 2018-19 and contributes about 7.7% to the overall GDP. It is expected to contribute about 10% to the GDP by 2025.”

I wonder how we have the IT industry that contributes over 7% to the nation’s GDP while complying with various acts that are as old as time.

Am I missing something? Are we really improving on the ease of doing business? Why are we having the laws that go back to 1936? Unless we do labour law reforms, we can't really improve our rankings any further or truly create a multi-trillion dollar economy.
