What powers could a newly elected American President exercise on ‘Day One’ in office? Declaring a National Emergency would be high on the To-Do List

“You know why I wanted to be a dictator [for one day]? Because I want a wall, and I want to drill, drill, drill,” Republican presidential candidate Donald Trump said during the New York Young Republican Club’s annual gala held on December 11, 2023.[1]

Being a dictator on ‘Day One’ was first introduced by the former president in an Iowa Town Hall interview on December 5 and quickly became the focus media coverage of the Trump campaign in the days that followed. Less attention has been given to the reasons Trump gave for the outlandish desire—to build a wall along the U.S.-Mexican border and “to drill, drill, drill.”

The building of a wall cannot obviously be done in a day. During the four years of Trump’s president (Jan. 20, 2017 to Jan. 20, 2020), the U.S. built new barriers along 455 miles (732 km) of the Southern border, 49 miles (79 km) of which previously had no barrier, according to U.S. Customs and Border Protection.[2]

The Defense Department paused construction of the wall along the U.S.-Mexico border after President Joe Biden declared Proclamation 10142, on January 20, 2021, ending the national emergency declaration, Proclamation 9844, declared on February 15, 2019, and renewed on February 13, 2020, that allowed Trump to use additional funds for the border wall, taking aim at a key part of Trump’s legacy.[3]

The authority claimed by President Trump through the declaration of a national emergency involved circumventing Congress to spend money it had expressly refused to authorize or allocate for the construction of the wall, an unprecedented step by an American Executive.[4]

On October 9, 2020, the U.S. Court of Appeals for the Ninth Circuit upheld the permanent injunction issued by a lower Federal Court against the use of emergency powers to fund construction of the border wall.[5]

Biden also issued on his first day in office Executive Order 13990, officially titled Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis, which revoked the permit for the Keystone XL Pipeline and temporarily prohibiting drilling in the arctic refuge.

In September 2023, the Biden administration cancelled seven Trump-era oil and gas leases in the Arctic National Wildlife Refuge to protect more than 13 million acres in the federal National Petroleum Reserve in Alaska.

Trump is signaling his intention to revoke Proclamation 10142 and Executive Order 13990, reinstating his claim of authority to redirect Pentagon funds authorized for other purposes to be used to restart border wall construction and to restart leases permitting oil and gas drilling in the Arctic National Wildlife Refuge.

Such an action to support construction by redirecting military funds would be contrary to the ruling of the U.S. Court of Appeals against the use of emergency powers to fund construction of the wall and could therefore be considered to be dictatorial.

The promise “to drill, drill, drill” in the Arctic National Wildlife Refuge, while controversial, may fall within the authority held by an American president. Both actions would likely end up back before the Court. __________________________________
