02. Are you Eligible for Long-term Working Visa LD1, LD2?

To work in Vietnam, foreign nationals must meet several requirements, including:

  • Nationality and Age: Must be a foreign citizen, at least 18 years old, and possess full civil capacity.
  • Health: Must meet the health standards set by the Minister of Health.
  • Qualifications: Must possess the necessary professional qualifications, technical skills, expertise, and work experience.
  • Legal Status: Must not be serving a criminal sentence, have had their criminal record expunged, or be under criminal investigation under foreign or Vietnamese law.
  • Work Permit: Must obtain a work permit from a competent Vietnamese authority, except in cases exempted from the permit requirement as stipulated by law.

In addition to the above requirements, foreign workers wishing to work in Vietnam must also ensure that:

  • Contract Duration: The duration of the labor contract signed with a Vietnamese enterprise does not exceed the validity period of the work permit.
  • Adherence to Law: During their employment in Vietnam, foreign workers must comply with Vietnamese labor laws and will be protected by Vietnamese law, unless otherwise provided for in international treaties to which Vietnam is a party.

  • Service Provider: As a service provider under a contract.
  • Service Offeror: As a person offering services.
  • NGO or International Organization: Working for a foreign non-governmental organization or international organization operating legally in Vietnam.
  • Representative: As a person responsible for establishing a commercial presence of a foreign business.
  • Volunteer: As a volunteer.
  • Project Involvement: Participating in projects or tenders in Vietnam.
  • Executives, Managers, Experts, or Technicians: As executives, managers, experts, or technicians.
  • Family Members of Diplomatic Representatives: As family members of members of a foreign diplomatic mission in Vietnam, subject to the provisions of international treaties to which Vietnam is a party.

04. Steps to Obtain a Working Visa

  1. Company Registration: The Vietnamese company registers its need to hire foreign workers with the relevant authorities.
  2. Legal Background Check: The foreign worker provides their legal background information for verification.
  3. Work Permit Application: The company applies for a work permit on behalf of the foreign worker.
