The Labor and Employment Law Section furthers the knowledge of its members in labor law and employment issues by providing a forum for California’s labor lawyers and non-lawyers with an interest in labor relations and employment issues. The mission of the Labor & Employment Law Section is to provide diverse educational opportunities and perspectives regarding labor and employment issues to our section members, to the bar, and to the general public. The Section provides educational opportunities throughout the year, including opportunities for online participatory MCLE credit and self-study MCLE credit. The Labor and Employment Law Section is a State Bar of California approved MCLE provider. I am pleased to share my latest "Wage and Hour Case Notes," a column I write for the California Labor & Employment Law Review. My column features three blockbuster decisions from the California Supreme Court. In Castellanos, the Court upheld the constitutionality of Prop 22, the ballot measure passed by voters in 2020 that defines app-based drivers like Uber and Lyft drivers as independent contractors, not employees. In Stone, the Court held that public employers are not subject to California's meal and rest break requirements, and can't be sued under PAGA. In Turrieta, the Court held that PAGA plaintiffs have no right to intervene in overlapping PAGA cases that settle out their PAGA claims, no right to object to settlements that extinguish their claims, and no right to move to set aside a judgment that extinguishes their claims. Turrieta effectively ends all appellate court review of PAGA settlements in California because plaintiffs in overlapping cases have no ability to become parties with standing to appeal (and the settling parties aren't going to appeal the court's approval of their settlement). It is a hugely disappointing decision to me and many other worker advocates who've had our righteous PAGA cases settled out from underneath us by unscrupulous attorneys. Enjoy!
