The first panel of the Young Lawyers Roundtable, moderated by Julianne Jaquith (Quinn Emanuel Urquhart & Sullivan, LLP), and composed of Courtney Giles (Baker McKenzie), Grace Haidar, J.D., LL.M. (aramco) Mark Stadnyk (thyssenkrupp nucera), and Rachel Howie (Dentons Canada LLP) shared key takeaways: 🌟 Confidentiality and venue selection: Priorities such as data protection and public image heavily influence arbitral seat selection, especially considering U.S. discovery practices. 🌟Applicable law and interim measures: Carefully drafted clauses can allow parties to address breaches and seek interim relief without halting ongoing projects. 🌟Cost recovery mechanisms: Clearly defined provisions reduce ambiguity and minimize disputes. 🌟Institution and arbitrator selection: The institution’s procedural framework, experience, and efficiency are crucial, while overly restrictive arbitrator qualifications should be avoided to prevent delays. The second panel, moderated by Rhianna H. Hoover (Debevoise & Plimpton) and featuring Brandon Caire (Air Liquide), Sylvia Leyva Martinez (Wood Mackenzie) and Tan Pham (TotalEnergies). The discussion highlighted: 🌟Emerging technologies: Key developments include CCUS, green hydrogen, solar, biogas, and nuclear energy, each with unique challenges and opportunities. 🌟Policy and incentives: Technologies like CCUS and green hydrogen depend on tax incentives for viability, while solar can thrive with lower rates of return. 🌟Unique challenges: Issues include underdeveloped legal systems in emerging markets, IP disputes, and difficulties in finding specialized expertise. 🌟Future trends: The sector is maturing, with predictions of market consolidation, heightened focus on water rights and IP, and evolving jurisprudence that may drive uniformity or encourage forum shopping. The panel also emphasized early community engagement to mitigate disputes and highlighted the growing importance of intellectual property in renewable energy projects. These panels underscore the evolving complexities of energy arbitration, from drafting effective arbitration clauses to addressing disputes in emerging energy sectors.
