The law in respect of restraints of trade has slowly been developing, and Courts have seemingly become more willing to interdict the infringement of proprietary interests, without taking the offending employee out of work. Cowan-Harper Attorneys was founded in 2009, with only two practitioners and a commitment to avoiding a traditional 'big firm' mentality. In 2018 the firm merged with MNA Incorporated and Cowan-Harper-Madikizela or CHM was born. Three members of that practice have also sat as acting Judges of the Labour Court in recent years. We are able to do this by ensuring that the correct legal strategies are put in place to limit risk and, where possible, to prevent disputes from arising in the first place, reducing the cost of litigation. Right to Disconnect: In this December Fact Sheet I explore the right to disconnect after hours from work. We will first consider global examples of legislating and realising this right. We will contextualise these examples and consider some of the relevant global policy and legislative trends. Thereafter, we will explore what it means for the South African context where there is no explicit defined right as such.
