About us

The Ou Hoofgebou (Old Main Building) is home to the Stellenbosch Law Faculty and is situated on the corner of Victoria and Ryneveld Streets in the centre of Stellenbosch. The Faculty of Law was established in 1921 and initially the Faculty only offered the LLB degree and focused on training and equipping students, not merely as legal practitioners, but also as jurists. The LLM degree (by thesis) was awarded in 1976 for the first time to two students. The Law Faculty introduced the LLM by course work in 1994. Today the Faculty offers postgraduate programmes to around 220 students. The staff of the Faculty of Law is passionate about legal education, research and social impact. Staff are highly qualified and include 14 National Research Foundation (NRF) rated researchers (1A, 6B, 5C, 2Y) that signify their international and national esteem as researchers. The Faculty is home to 4 research chairs: The HF Oppenheimer Chair in Human Rights (Prof Sandra Liebenberg), the Anton Mostert Chair in Intellectual Property Law (Prof Sadulla Karjiker), The Law Faculty Trust Chair in Social Justice (Prof Thuli Madonsela) and The South African Research Chair in Property Law (Prof Zsa-Zsa Boggenpoel). The Faculty is the home of the SU Law Clinic. The Law Clinic transitioned into a fully-fledged Legal Aid Clinic in 1987, after starting out in 1975 as a Legal Aid Scheme operated by senior law students who provided legal assistance to indigent communities of Stellenbosch. Today the Law Clinic presents practical legal training to law students and continues to offer legal services to indigent persons. The Law Clinic assists with various civil matters, for example divorces, contracts, family law and debt.     📸 𝑻𝒉𝒆 𝟕𝒕𝒉 𝑩𝒊𝒂𝒏𝒏𝒖𝒂𝒍 𝑮𝒆𝒓𝒎𝒂𝒏-𝑺𝒐𝒖𝒕𝒉 𝑨𝒇𝒓𝒊𝒄𝒂𝒏 𝑫𝒊𝒂𝒍𝒐𝒈𝒖𝒆 𝒐𝒏 𝑫𝒆𝒎𝒐𝒄𝒓𝒂𝒄𝒚 On 6 and 7 February 2025, The University of the Western Cape (UWC Faculty of Law) and Stellenbosch University (SU) hosted the 7th Biannual German-South African Dialogue on Democracy, bringing together leading legal scholars, policymakers, and researchers to examine the complex relationship between democracy, the social state, and the economy. The event featured a keynote address by Justice Steven Majiedt of the Constitutional Court of South Africa, who explored the evolving role of socio-economic rights in fostering a more inclusive democracy. Discussions over the two days highlighted how economic inequality, globalization, and shifting governance structures are shaping democratic institutions in South Africa, Germany, and beyond. The dialogue was attended by UWC’s Rector and Vice-Chancellor, Prof Robert John Balfour, as well as H.E. Mr. Andreas Peschke, the German Ambassador to South Africa, underscoring the international significance of the discussions. Legal experts such as Prof. Sandra Liebenberg (Stellenbosch), Prof. Michael Rodi (Germany), Dr. Sanele Sibanda (Pretoria), and Prof. Johanna Wolff (Osnabrück) led thought-provoking sessions on: ✔️ The constitutional foundations of democracy and economic justice. ✔️ The erosion of democratic citizenship due to economic marginalization. ✔️ Strategies for increasing democratic accountability in economic decision-making.     Research and Advocacy Officer at Judges Matter

    I was honoured to serve as a respondent to Prof Sandra Liebenberg and Prof Michael Rodi’s brilliant presentations on the panel on Democracy and the Social State. I thoroughly enjoyed both papers and the conversation that followed. There were fascinating insights on the impact of the South African Constitution and the German Basic Law (Grundgesetz) on socio-economic rights and democracy in both countries. Ours was the opening panel of the 7th Biannual German-South African dialogue on democracy, under the theme ‘Democracy, the Social State and the Economy’, co-hosted by Stellenbosch University Faculty of Law and UWC Faculty of Law, and partners from Germany. The dialogue kickstarted with an insightful lecture by Constitutional Court Justice Steven Majiedt, titled “Towards a holistic, responsive and transformative jurisprudence on socio-economic rights”.

    Advocate of the High Court of South Africa and a Member of the Johannesburg Bar

    In less than a month, I’ll be riding the Cape Town Cycle Tour (formerly known as the Argus). This year, I’m riding with the Stellenbosch University Faculty of Law and we are raising funds as part of the University’s #Move4Maties fundraising campaign. #Move4Maties supports the “missing middle” students at Stellenbosch University—those who are unable to access state financial aid (NSFAS), and still struggle to afford their education. This campaign is close to my heart because, during my time at Stellenbosch, I was also #CaughtInTheMiddle, and I probably wouldn't have made it without generous donors and sponsors.     Early this week, I had an opportunity to present my paper at the African Cyber Law Conference in Johannesburg. I received some great inputs and came back with new ideas for future papers. The highlight of my day was bumping into my former Tax lecturer Carika Keulder , I always enjoyed how she taught tax and I will draw inspiration from her for the start of the teaching block!     At last! The 7th German South African Dialogue on Democracy has commenced this evening. Justice Majiedt of the South African Constitutional Court delivered the inaugural address in the Ou Hoofgebou of Stellenbosch University. Professor Henk Botha and the Dean of the Stellenbosch University Faculty of Law, Professor Nicola Smit, welcomed Justice Majiedt, who then delivered an address on transformative jurisprudence in relation to socio-economic rights. He examined the Constitutional Court's decisions, particularly those related to housing, and outlined the ongoing challenges. This set the perfect tone for the remainder of the conference. On the second day of the conference, three panels will discuss at the University of the Western Cape the social and economic dimensions of democracy: Economic globalization, the ascendancy of what is referred to in social theory as a neoliberal governing rationality that reduces citizens to economic actors and treats poverty as the result of individual choices, and growing economic inequality appear to have contributed to the erosion of the social and material basis of democracy and democratic citizenship. We will discuss the consequences of these developments and how to counter them, comparing the South African and German constitutional orders.

  • Our LLM General programme offers 15 modules in this first semester of 2025. A new addition to our offering is the module Advanced Human Rights Law. Prof Sandra Liebenberg, NRF A1-rated researcher and HF Oppenheimer Chair in Human Rights Law, will be the course leader and presenter. This module will focus on how human rights law responds to key contemporary challenges such as: • How to hold powerful private actors accountable to human rights norms? • Can human rights law make a meaningful difference to people living in poverty? • What can be done to combat various forms of inequality – race, gender, nationality and many others? • How do we reconcile the right to freedom of expression with growing trends of hate speech? • How should expressions of religious and cultural diversity be accommodated in our public institutions such as schools? • What is the influence of private funding on citizen’s political rights and what initiatives are available to limit this influence? These themes will be examined through the lens of the South African Constitution and Bill of Rights, but the module takes a wide angle by incorporating perspectives from other constitutional law systems as well as regional and international human rights law. South Africa has many similarities with other countries that have sought to design constitutional systems, including fundamental rights, to be responsive to the legacies of past conflicts and injustices. The module will be interactive and focused also on developing students’ capabilities in legal research, writing and presentation skills. The Faculty is excited that students will be able to add this important module to their general LLM programme design. #LLM #postgraduate
