Customisation is crucial - consider their type, structure, and purpose carefully. ➡️ Dispute boards can resolve or prevent disputes. Two-thirds of respondents reported compliance with decisions or recommendations, underscoring their potential to save time and costs. ➡️ Enforcement challenges remain. While compliance is common, there’s still work to be done on efficient enforcement mechanisms. ➡️ Early investment pays off. An upfront commitment to a standing dispute board can prevent costly litigation or arbitration later. ➡️ The devil is in the detail. The construction industry continues to navigate the Building Safety Act 2022 (BSA) and its retrospective effect on claims under the Defective Premises Act 1972 (DPA). In BDW Trading Ltd v Ardmore Construction Ltd [2024] EWHC 3235, the TCC upheld an adjudicator's jurisdiction to decide a DPA claim, reaffirming the principle that disputes "under" a contract can include statutory DPA claims. The decision relied on Fiona Trust principles, supporting a broad interpretation of adjudication clauses. While the industry awaits the Supreme Court’s ruling in the URS Corporation v BDW Trading Ltd appeal, this judgment highlights adjudication as a potentially crucial tool for addressing fire safety disputes.
