Transport & Logistics alert: How transport and logistics companies may mitigate risk with contractual liens In today’s uncertain economic climate, marked by inflation and high interest rates, many industries are struggling with clients who are late on payments. The transport and logistics sector is no exception. However, these companies may mitigate their risks by including contractual liens in their service agreements. A contractual lien is created by incorporating a lien provision into a contract. It enables the service provider in possession of the goods to maintain possession of those goods until all outstanding invoices are paid in full and if not paid, to sell the goods. In our latest Transport & Logistics alert, Jenna Bayindir breaks down the benefits of a contractual lien through the Federal Court of Australia's recent decision in Nick Scali v Lion Global Forwarding Pty Ltd. Read more >> https://bit.ly/3AUVEpy If you would like to discuss how your business can benefit from a contractual lien, or if you have had a supplier claim a lien against your goods, please contact a member of our Transport and Logistics team below: Elizabeth Guerra-Stolfa, Partner, on +61 3 9321 7864 Ian Rosenfeld, Partner, on +61 3 9321 7850 Andrew Hudson, Partner, on +61 3 9321 7851 #RigbyCookeLawyers #Melbournelawyers #lawyers #contract #liens #transportandlogistics #caselaw #auslaw

Customs & Trade alert: Australia inks new FTA deal with UAE Australia's trade landscape has been significantly shaped by the country's involvement in a variety of free trade agreements (FTA), spanning bilateral, regional, and plurilateral frameworks. Many of these agreements have unlocked valuable opportunities for Australian businesses, with notable successes including recent FTAs with the United Kingdom and the initial phase of negotiations with India. However, not all negotiations have progressed smoothly. The anticipated FTA with the European Union, for example, stalled in 2023 due to disagreements over trade terms, particularly in relation to agricultural exports and geographical indicators. Despite these setbacks, Australia continues to forge ahead with other trade deals, most recently with the United Arab Emirates (UAE). In our latest Customs & Trade alert, we explore the developments surrounding Australia's ongoing FTA negotiations, with a particular focus on the UAE’s Comprehensive Economic Partnership Agreement (CEPA), its potential economic impact and its implementation. Read more >> https://bit.ly/3NVMFHh If you are an individual or Australian business and would like to discuss how the free trade agreements could affect your business, please contact a member of our Customs & Trade team below: Andrew Hudson, Partner, on +61 3 9321 7851 Alexander Uskhopov 文龙, Associate, on +61 3 9321 7806 #RigbyCookeLawyers #MelbourneLawyers #customs #trade #FTA #CEPA #freetradeagreements #auslaw
