Judgment Just In: Vamadevan v The King [2024] NSWCCA 223 The Court of Criminal Appeal has dismissed Mr Gerard Vamadevan’s appeal against his sentence for eight Commonwealth offences. In resentencing, the Court held that it was not obliged to apply s 66 of the Crimes (Sentencing Procedure) Act 1999 (NSW) in deciding whether to make an intensive corrections order for a federal offender and that following resentencing, a lesser sentence was not warranted in law. The farewell ceremony for the Honourable Justice Richard White will be held on 19 December 2024 at 9:15am, in the Banco Court. Justice White was sworn in as a judge of the Supreme Court on 27 April 2004 and elevated to the Court of Appeal on 15 March 2017. Chief Justice Andrew Bell and the Judges of the Supreme Court of New South Wales have offered their deepest sympathies to the family of the Honourable Tom Hughes AO KC, who died today aged 101. “Tom Hughes was a wonderful man, of large spirit, great style and a true patriot. He had a deep love of country and Australian history in which he was an active participant and player. He will be greatly missed but his legend will live on in the court rooms of Australia”, the Chief Justice said in a vale notice released today.

Judgment Just In: HNOE Limited v Angus & Julia Stone Pty Ltd [2024] NSWCA 271 The Court of Appeal has allowed an appeal brought by HNOE Limited, Manton Music Management Pty Ltd and Mr Tim Manton against musicians Mr Angus Stone, Ms Julia Stone and Angus & Julia Stone Pty Ltd and stayed proceedings concerning the alleged overcharging of commission payments, in breach of an agreement between HNOE Ltd and the Stones, and the Entertainment Industry Act 2013 (NSW) by reason of an English exclusive jurisdiction clause. Judgment just in: Macdonald v R [2024] NSWCCA 198 The Court of Criminal Appeal has dismissed an appeal from Mr Macdonald’s convictions for wilful misconduct in public office and his sentence of imprisonment for eight years. The convictions concerned Mr Macdonald’s decision to grant a coal exploration licence to a mining company for the improper purpose of benefiting that company. Given evidence of circumstances surrounding the decision, including the relative unfavourableness of the licence to the State, the refusal to open the allocation to competitive tender and the unusual haste with which the direct allocation was pursued, the Court held the verdict was not unreasonable.
