🌍 On Tuesday, Sven Demeulemeester had the privilege of speaking at the 2024 European Club Association (ECA) Financial Sustainability Conference in Geneva.   💡 The fight against money laundering is vital to ensuring a sustainable future for European football. As European clubs prepare for the implementation of the new European Anti-Money Laundering (AML) Regulation and Directive, raising awareness about these critical legal developments is more important than ever.   ⚖️ Since 2021, Belgium has applied AML rules to the football sector, and ATFIELD Sports Law has been guiding Belgian clubs through this complex and essential framework. Whereas, initially, existing AML rules were transposed to the sector of Belgian football without taking into account the specifics of the sector, additional finetuning of the rules in 2023 resulted in a workable legal framework. 🚨 Diarra Case - Breaking News! 🚨   According to the European Court of Justice (ECJ), and largely following Advocate General Szpunar’s Opinion of 30 April 2024, FIFA's transfer system (at the very least, the consequences provided for in the event of premature termination without just cause) is contrary to Articles 45 and 101 TFEU!   The following slides provide a summary of the ECJ’s reasoning in the Diarra case and highlight its potential implications.
