WHO ARE WE? SEE Legal is a unique regional group of leading independent law firms from ten countries in South East Europe covering the twelve jurisdictions in the region. For the past 20 years, SEE Legal has continued to develop into a highly-integrated regional legal service provider. The Group has its own structure (management, administration, regular meetings, practice groups), supporting infrastructure (intranet, website, knowledge management and clients database), different policies (including one-stop shop, one invoice and one single Letter of Engagement), marketing and business strategy, several publications in the form of guides and newsletters, organises international and national conferences and events. SEE Legal has established and continues to develop integrated regional practice groups in Competition, Energy-Infrastructure, Banking & Finance and M&A.     EU’s New Product Liability Rules: Game-Changer for AI & Software Businesses On November 18th, 2024, Directive 2024/2853 on Liability for Defective Products (“PLD”) was published in the Official Journal of the EU. PLD shall replace Directive 85/374, after 40 years from its entry into force, in order to align with the emergence of ground-breaking technologies, such as AI. It is part of EU’s AI Strategy (along with Regulation 2024/1689 known as “AI Act” and the Proposal for AI Liability Directive, known as “ALID”). The EU’s updated product liability rules transform how businesses handle software and AI. Key takeaways: ·   Software = Product: Software, including SaaS and cloud-based tools, is now considered a product. Defects can trigger liability, just like physical goods. ·   AI Liability: AI developers are accountable as manufacturers. Liability applies to defects in AI systems, including those arising from self-learning capabilities or unsafe algorithms. ·   Cybersecurity Risks: Failing to provide updates to address cybersecurity vulnerabilities makes manufacturers liable for damages caused by unsafe products. ·   Open-Source Software: Open-source is excluded unless integrated into a commercial product, transferring liability to the manufacturer of the final product. ·   Smart Services Included: Integrated digital services, like AI-driven health monitors, are treated as components, with liability for defects falling on manufacturers. ·   Easier Claims for Complex Tech: Victims of AI or software-related damages need only demonstrate the likelihood of a defect and its link to the harm caused. ·   Broader Scope: Includes digital manufacturing files and AI products that evolve post-sale, ensuring accountability across the product lifecycle. Countdown to 2026: The Directive takes full effect on 9 December 2026. Businesses have two years to adapt to these groundbreaking rules, ensuring compliance and minimizing liability risks.     On November 15th, 2024, Law 5157/2024 was enacted, bringing significant reforms to improve access to healthcare services, enhance system efficiency, and prioritize prevention.   The Law establishes the Personal Physician as a central pillar of primary care, responsible for prevention, chronic disease management, specialist referrals, and updating Personal Health Records. Registration with a Personal Physician is now mandatory for all adults, with certain exceptions. A new evaluation system will assess Personal Physicians based on qualitative and quantitative performance indicators.   Eight University Healthcare Centers are introduced, linked to universities, offering services like telemedicine, preventive medicine, and public health research, while also serving as training hubs for healthcare professionals.   Finally, measures are foreseen to strengthen prevention and target major public health challenges such as obesity and excessive alcohol consumption.   Access the Law here: https://shorturl.at/t5nik #HealthcareReform #PersonalPhysician #PublicHealth #PreventiveCare #PrimaryCare

    On 7 November 2024, BOYANOV & Co. with the support of the European Investment Bank (EIB) organised the international conference "Life-Cycle Challenges of the Start-Ups". With this conference, BOYANOV & Co. reaffirmed its commitment to supporting the start-up ecosystem in Bulgaria The increase in the number of high-tech startups in Bulgaria is a significant trend. There is a high potential for the development of startups in the coming years in the following sectors: biotechnology, fintech, Internet of Things, smart cities, artificial intelligence (AI), virtual and augmented reality, robotics, electric vehicles (EVs) and autonomous cars, drones, 3D printing, process digitalization. Southeastern Europe (SEE) is the fastest-growing region in Europe in terms of funding start-ups over the period 2019-2023. In Bulgaria, the anticipated injection of 520-620 million EUR public capital over 2025-2029, alongside the Eurozone joining, is expected to leverage the start-up ecosystem development to the next level. Bulgaria leads the charts in terms of start-up density across SEE. The main challenges and current problems were identified as follows: lack of funding at the end of 2024, with hopes for new sources of financing in 2025; necessity of restoring Bulgarian start-ups' competitive edge; need for Bulgarian institutions to take a more active role in removing obstacles for pension funds and VC funds to invest in start-ups; significant portion of the investment in start-ups is related to AI, etc. Read more here: https://lnkd.in/dvQEbKu8

    On November 13rd, 2024, the draft Law transposing into Greek legislation Directive (EU) 2022/2555 on measures for a high common level of cybersecurity across the EU (NIS2 Directive) was introduced to the Greek Parliament, following the conclusion of the public consultation procedure on November 2nd.   The draft Law features significant amendments and additions, especially for the cybersecurity οbligations of public electronic communications network providers.   It has now been allocated to the competent parliamentary committee for further processing and discussion and will be thereafter introduced to the Plenary for approval.   Τhe law-making procedure is expected to have been completed before January 17th, 2025, i.e. the date by which obligated entities should have declared to the National Cybersecurity Authority the information necessary for their inclusion into the ENISA registry of entities providing cross-border services.   #NIS2 #cybersecurity #electroniccommunications #ENISA
