The Mechanical Licensing Collective (MLC) has announced its intent to audit 49 Digital Service Providers, from Spotify to Amazon. This historic move, the first of its kind in the 115-year history of the U.S. compulsory mechanical license, is a significant stride towards ensuring fair royalty payments to songwriters and music publishers.
Why is this good news for rights holders?
Transparency and Accuracy: By auditing DSPs, the MLC ensures that royalties are reported accurately, protecting the interests of rights holders.
No Cost to Rights Holders: The audits are funded by the MLC’s operational budget, which comes from DSPs, ensuring that songwriters and publishers don’t bear any additional costs.
Fair Distribution of Royalties: If audits reveal any underpayment, the MLC will distribute the full recovery amount to impacted rights holders without deducting any costs.
As Alisa Coleman, Chair of the Board of Directors of The MLC, states, "The MLC’s audit right provides enhanced protection for songwriters and music publishers."
This move underscores the commitment to uphold the standards set by the Music Modernization Act and represents a significant victory for transparency and fairness in the digital music era. It's a win for rights holders, ensuring that their creative work is valued and compensated appropriately.
