At the end of October, Tudor Gagea and I completed a four-day hearing at the Licence Appeal Tribunal. The sole issue in dispute was whether our client Ryan Armstrong sustained a “catastrophic injury” as a result of a car crash. The case was of utmost importance to Mr. Armstrong because it was an all-or-nothing outcome. If successful, Mr. Armstrong would gain access to $1 million in funding for his medical, rehabilitation, and treatment costs. If unsuccessful, he would get nothing. I am pleased to share that we were successful in proving that Mr. Armstrong had three marked impairments and was deemed “catastrophically impaired” based on Criterion 8. Key takeaway for litigators: the LAT was not messing around regarding documents being served and filed in accordance with the deadlines set by the Case Conference Report and Order. The following documents were excluded because they were not served/filed 21 days before the start of the hearing. Excluded documents: supplementary document brief (with documents that had been previously disclosed), DSM-5 reference materials, documents to be used in cross-examination, and even relevant case law.
