Tom Henderson from Capital Trustees has commented on the new #UK #Budget released October 30, 2024. As expected, the UK Budget yesterday included significant changes to the taxation of non-UK income and gains for UK resident, non-UK domiciled individuals, with the current remittance basis and #trusts regime being replaced by a favourable four-year window for eligible UK residents, and new arrivers, from April 2025. Inheritance Tax moves from a domicile-based to a residence-based regime, also from April 2025. These individuals, particularly those with trust arrangements, will need to take advice now to assess how they will be affected from April 2025 onwards, and plan accordingly. There may be new #structuring opportunities for long-term non-UK resident individuals with a UK domicile. Trust arrangements remain as attractive and effective #successionplanning vehicles for many international families.

This decision effectively repeals penalties for entities that did not demonstrate substantial economic activity for financial years commencing after December 31, 2022.

Michele Cecchi of Capital Trustees comments on Jersey's government July 8th 2024 proposed amendments to the Trusts (Jersey) Law 1984, following discussions with local trust law practitioners. Key changes include clarifying the priority of claims between current and former trustees, modifying beneficiaries’ rights to terminate or vary trusts, the ineffectiveness of the resignation rendered by a sole trustee prior to the appointment of his successor. The discussion included also the introduction of provision for "pure data trusts" to enhance digital asset management. The deadline for the submission of comments was August 16th, with further amendments anticipated later this year. No further news regarding decisions had been published yet. #JerseyLaw #Trusts #News

In the latest semi-annual STEP Hong Kong branch newsletter, Yumei Zhang TEP, ACSI, PhD of Capital Trustees analyzed the use of #PreIPO family trusts. These #trusts are usually #reservedpowers trusts established by the founder or major shareholder of a company planning to be #listed. Typically, the founder or #shareholder transfers their shares into a trust for the benefit of their family before the company applies for public listing. As Yumei explains in her article, there are many advantages to setting up these structures. For instance, they may facilitate a successful listing and prevent negative personal circumstances from impacting the process.
