Les justices allemande 🇩🇪, belge 🇧🇪, française 🇫🇷, néerlandaise 🇳🇱 et suisse 🇨🇭 ont ouvert des procédures judiciaires contre d’anciens responsables du régime syrien de Bachar al-Assad, dont certaines ont débouché sur des condamnations, grâce à l'application du principe de #CompétenceUniverselle. En #Suisse, "L’ancien vice-président syrien, Rifaat al-Assad, 87 ans, oncle de Bachar, est poursuivi pour #CrimesDeGuerre et #CrimesContrelHumanité pour les massacres perpétrés à Hama en 1982. L’affaire a longtemps végété dans les tiroirs du Ministère public de la Confédération helvétique – la plainte a été déposée en 2013 par l’ONG TRIAL International, alors que l’homme séjournait à Genève. Le dossier avait repris de la consistance avec l’émission d’un mandat d’arrêt international, le 16 août 2023, par la justice helvétique. The A v. Office of the Attorney General of Switzerland case was one of the first cases based on universal jurisdiction in Switzerland since the new law providing Switzerland with jurisdiction to prosecute war crimes, crimes against humanity and genocide, including when these crimes were committed abroad, by foreigners and when none of the victims were Swiss nationals, came into force. This legal principle was used as an avenue for victims to seek justice for the crimes committed by the former defense minister Khaled Nezzar. Great news from #Denmark. Having sound legal frameworks is the first necessary step for countries to be able to join the fight against impunity for crimes under international law. Be it for investigating or prosecuting foreign suspects under the principle of #UniversalJurisdiction, or doing the same for its own nationals

The Danish Parliament has today, with 100 votes in favor and 9 against, added an entirely new chapter to the Danish Penal Code, criminalizing #torture, #warcrimes, and #crimesagainsthumanity. This is great news. Bill L58 ratifies the amendment to the Statute of the International Criminal Court regarding the crime of aggression, as well as provisions on the ten war crimes added to the ICC Statute since its entry into force in 2002, which Denmark had not yet ratified. These include #genocide, the prohibition of using certain weapons as a method of warfare, and the use of #starvation of civilians as a method of warfare in non-international armed conflicts. Together with DIGNITY and the Danish Institute for Human Rights we worked intensively on this specific legislation while I was at the Amnesty International Denmark Secretariat. My hardworking team member Elise Margrethe Bangert was part of the preparatory War Crimes Committee, supported by the also hardworking Lisa Blinkenberg. Dignity has since then done important heavy lifting in the parliament, providing crucial input for decision-makers up to this very final step. It is now crucial that the principle of #universaljurisdiction is effectively implemented in Denmark, ensuring that these crimes are investigated and those responsible are held accountable in Danish courts. Regardless of whether they come from Russia, Israel, Syria, Myanmar, Sudan or any Western country. This requires sufficient #resources for the police and the judiciary. “Rifaat al-Assad’s crimes, particularly the 1982 Hama massacre, are among the gravest atrocities of our time,” said ⚖️ Philip Grant, executive director of TRIAL International, which filed the criminal complaint against him in Switzerland in 2013. 🔎 The Guardian, in partnership with The Bureau of Investigative Journalism, have led a joint investigation into the dubious European assets of Bashar al-Assad's uncle. His current whereabouts are unknown, but the Swiss Office of the Attorney General issued an international arrest warrant against Rifaat al-Assad in 2021 and indicted him for #WarCrimes and #CrimesAgainstHumanity in March 2024. A date for his trial has not been announced yet. The NGO Sherpa, which initiated the French criminal complaint against Rifaat al-Assad, called on European governments to use the money from asset seizures to help Syrians. 👉 https://lnkd.in/eeRNbAAP

🏅 Une reconnaissance pour un combat de longue haleine en faveur de la justice La semaine dernière, ⚖️ Philip Grant, directeur de TRIAL International, a reçu un prix des droits humains de la part de l'Association des Victimes de Torture (AVTT). Cette distinction, remise à l’occasion de la Journée internationale des droits humains, met à l’honneur son engagement pour défendre les victimes de crimes internationaux, notamment dans l’affaire d’Abdennacer Naït-Liman, président de l’AVTT. Abdennacer Naït-Liman, réfugié en Suisse, a été victime de torture en Tunisie en 1992. Pendant 17 ans, il a mené un combat juridique pour que justice soit rendue, en déposant une plainte en Suisse contre un ancien ministre tunisien de l’intérieur, qui l'a amené jusqu'à la Cour européenne des droits de l'homme. Bien que la Grande Chambre de la Cour européenne des droits de l'homme ait rejeté sa requête en 2018, son affaire reste un symbole puissant de la lutte pour les droits des victimes de torture. Le FONAREV a co-organisé, ce lundi 16 décembre, à son siège social, avec l’Ambassade du Royaume-Uni en RDC, une conférence de presse à l’occasion de la présentation et du dépôt officiel du rapport de recherche documentaire sur les crimes graves commis dans la province du Sud-Kivu entre 1994 et 2024. Ce rapport, qui retrace les incidents et les crimes survenus dans le Sud-Kivu, a été élaboré par le Groupe Technique Justice Transitionnelle dans la province du Sud-Kivu, un collectif d’organisations de la société civile œuvrant dans le domaine de la justice transitionnelle, avec le soutien de Trial International et de l’Ambassade du Royaume-Uni en RDC, représentée lors de cette conférence par Mme Alyson King , Ambassadrice de Sa Majesté. Le document a été remis symboliquement par M. Raphaël Wakenge Ngimbi, modérateur du groupe, au Directeur Général du FONAREV, M. 🚨 On 15 December 2024, the #ECOWAS Authority of Heads of State and Government has approved the establishment of the Special Tribunal for #TheGambia. TRIAL International welcomes this historical step towards accountability in the country and congratulates all those who have contributed to making this landmark decision possible! ⚖️ The aim of this groundbreaking initiative is to prosecute perpetrators of gross human rights violations committed between 1994 and 2017, under the regime of former Gambian president Yahya Jammeh. The tribunal will complement the work of the 2019-2021 Truth, Reconciliation and Reparations Commission, which documented widespread abuses, including #ExtrajudicialKillings, #torture and #EnforcedDisappearances. For the first time, ECOWAS is partnering with a member state to create an internationalized tribunal to address crimes of such gravity within a member nation’s borders.
