Expert evidence can make or break regulatory investigations. Stephen Hooper highlights the risks of relying on inadequately qualified experts - as seen in our successful defence of an Oral and Maxillofacial Surgeon against allegations of misconduct by the General Dental Council (GDC). When cross-examination revealed the GDC’s expert hadn’t placed an implant in 20+ years or performed a sinus lift, the case collapsed. The appointed Professional Conduct Committee (PCC) dismissed all allegations, echoing the General Medical Council’s earlier decision to close its investigation on the same grounds. My name is Ton van den Bosch. Please allow me to introduce myself. I am a dual qualified lawyer, admitted as an English solicitor and as an “advocaat” to the Dutch bar. After more than eight years in private practice with another global law firm (in Singapore, Amsterdam, Jakarta and New York), I moved in-house to become the GC of a privately owned oil & gas contractor. In the summer of 2013, I assumed the role of GC of a listed global container terminal operator with headquarters in the Philippines. In 2017, I moved back into private practice and I am a partner in the Singapore office of Clyde & Co. I am originally from the Netherlands and have lived in Asia for more than a decade now. The vibrant cultures, great food, diverse communities and dynamic opportunities here continue to inspire me. Southeast Asia has truly become a second home for our family and me and it is a privilege to embrace and contribute to Asia’s growth while cherishing my Dutch roots. From Singapore, we advise our clients on corporate transactions and project development in the offshore, renewable energy, agriculture, logistics and ports sectors in emerging and frontier markets in Africa, the Middle East and here in Asia. In my view, project development is a great specialisation for lawyers because it brings abstract legal concepts to life through tangible outcomes, like for example an FPSO producing oil offshore Malaysia, or a container terminal operating in Indonesia. The thrill of a site visit - donning safety boots and a hard hat - adds a dynamic edge to the legal work and deepens the connection to the project, from a port in a remote part of the Philippines or a shipyard here in Singapore.
