🌐 I work remotely, so it is especially great when I get the chance to spend a full day speaking to incredibly smart people, in person, about my favourite topic - platform governance! Yesterday I joined Martin Husovec Platform Regulation class at The London School of Economics and Political Science (LSE) to discuss careers at the intersection of Trust & Safety and compliance. I loved the thoughtful questions and hope to have sparked interest in this fast-growing and impactful field. Later, we sat down with Martin Husovec, Prof. Lorna Woods, and Curtis Barnes to discuss the recent risk assessment and audit reports published in compliance with the Digital Services Act. Some key insights 💡 Appreciate the context: The first DSA risk assessment and audits were an unprecedented and complex exercise, with auditors and platforms navigating this for the first time. So while it’s not perfect, there is plenty here that serves towards the transparency and accountability goals of the DSA. Systemic risk assessments: There is significant variation in how companies implement and understand the obligations (which, barring guidance, was to be expected) - there is a lot of information that can be considered a good baseline, especially for content risk. The audits are already having an impact: Following auditors' recommendations, companies are course-correcting on their implementation of the DSA and taking steps to improve internal processes. What’s next? The European Commission and Digital Services Coordinators are working towards guidance for risk assessments. It would be useful if this included feedback on what is good and what could be improved in the methodologies deployed, the depth of analysis on systemic risks, and the metrics, especially around risks stemming from design and functionality. For the audits, a key challenge is that there are nearly no independent benchmarks or standards for many ambiguous terms in the DSA (e.g., timely processing, user-friendly). This means that auditors can only audit against companies internal benchmarks to evaluate compliance. Standards and benchmarks in this space are likely the next step to mature the implementation of the DSA. All in all, we noted that the DSA sets an extremely high bar under very tight timelines in an industry that has previously been largely unregulated. We can expect this industry—also in response to rules from the UK OSA—to mature in risk governance over the coming years. This is still just the beginning of compliance in the T&S space, so buckle up for a lot more nuanced discussions (and an extensive amount of reading!). At Tremau, we will be following this closely and providing insights along the way! #PlatformGovernance #DigitalServicesAct #TrustAndSafety #Compliance #LSE

🇪🇺👀 DSA Updates 🔵 The 'Code of Conduct on Countering Illegal Hate Speech Online +' is now integrated into the Digital Services Act. 🛡️ It will strengthen how online platforms address content defined as illegal hate speech in the EU and mitigate risks of dissemination of illegal content online. 👉🏻 While adherence to the Code is voluntary, platforms that sign up commit to: 🔸 Sharing data: Report on measures taken against hate speech, including detailed, country-level stats and internal classification; 🔸 Transparency: Let 'Monitoring Reporters'(e.g., trusted flaggers or public entities) assess how hate speech reports are reviewed; 🔸 Quick action: Strive to review at least 2/3 of hate speech notices within 24 hours; 🔸 Raising awareness: Work with civil society to educate users on illegal hate speech and flagging procedures.

2025 is the year of action for services to comply with the UK’s Online Safety Act. With in-scope services required to conduct their first illegal content risk assessments by 16 March 2025, and the illegal content safety duties expected to become binding from 17 March 2025, this is a critical time for platforms to prepare. To dive into the key challenges surrounding these risk assessments and share insights from our work to date with several online platforms at Tremau, I’ll be joining a discussion with Silvia Fukuoka (Ofcom) and Emma Drake & Heather Catchpole (Bird & Bird) During this webinar, we’ll take a deep dive into the risk assessment process, focusing on: ✅ Navigating the Ofcom guidance and structuring your assessment; ✅ Identifying and efficiently gathering the required evidence; and ✅ Selecting and prioritising measures to prepare for the illegal harms duties coming into force. 👇🏻 Click below to register: #OnlineSafetyAct #Compliance #RiskAssessment
