    Recently had the wonderful albeit brief opportunity to attend the annual conference held by Corporate Counsel Association of India (CCAI) at #Munnar, #Kerala. Reached directly from Dubai to Kochi and then joined the group of General Counsels and Leading Lawyers from different parts of the Country, to travel to Munnar together. Munnar is a picturesque hill station about 3 hours by road from Kochi and is surrounded by rolling hills with beautiful tea plantations. I shared my thoughts in the Opening Session on the basic foundation of our Constitution, Sovereign, Socialist, Democratic and Republic, which provides for Rule of Law and ensures safeguarding the liberties of Citizens as well as their fundamental rights. It also provides for independent authority of state and its powers to legislate. It ensures achievements of socialist goals through distributive justice as well. There were introductory remarks from the stalwarts like, Mr. Badrinath Durvasula Mr. Balakrishna Gopalakrishnan Mr. Manish Lamba, Mr. Karan Singh Chandhiok and Ms. Deepika Chaudhry. The rest of the sessions were very engaging and informative and there were many takeaways from the varied discussions on interesting and upcoming issues. My colleagues Mr. Shantanu Malik and Mr.Rohit Jolly also participated in the conference and had wonderful interactions with all the attendees!! Kudos to Mr. Sunil Patel for an incredibly organised conference in such beautiful locale and too impeccably.     🌟 Honoured to Speak at the 46th Annual Conference of the Association of Obstetricians and Gynaecologists 🌟 On November 22, 2024, at the India Habitat Centre, Delhi, I had the privilege of addressing a gathering of over 200 medical practitioners at the 46th Annual Conference organized by the Association of Obstetricians and Gynaecologists of India (AOGD). My talk centred around educating medical practitioners on the essential elements carved out by Courts in different judicial pronouncements with respect to criminal aspects of Medical Negligence. I apprised the medical practitioners about the leading decisions rendered by the Supreme Court in Jacob Mathew vs State of Punjab and Dr. Suresh Gupta vs. v. Govt of NCT of Delhi and elaborated on the principles established in these judgments. Subsequently, I shed light on the different penal provisions governing criminal medical negligence brought out by the newly enacted, Bhartiya Nyaya Sanhita (BNS), 2023 which came into force on 01.07.2024. Finally, I provided a comparative analysis between the Indian Penal Code (IPC) and the BNS, emphasizing both their similarities and differences.     Doing Land Due Diligences in India comes up with its own myriad challenges and I gained valuable insights from my extensive experience in recently conducting due diligence on 400 acres of land across diverse locations including Goa, Delhi, Mangalore, and Ayodhya. The process involved thorough searches related to ownership, title verification, zoning, litigation, encumbrances, government acquisition, and obtaining necessary statutory clearances and approvals. Each jurisdiction presented its own unique set of challenges: Goa posed particular difficulties due to the applicability of Portuguese law(pre and post liberation of Goa), applicable / governed the land ownership and transfers in the region. In Ayodhya, we encountered complexities related to lands owned by religious Trusts or Maths, where identifying rightful owners was challenging—particularly in cases where no formal title documents existed or ownership changed following the death of a spiritual leader (Guru). In Delhi, when dealing with agricultural land, we had to secure the necessary permissions from relevant authorities. This process involved visits to archive offices, meeting with local village administrative officers (Patwaris). Although online searches and digital documentation platforms are useful, they are not sufficient for comprehensive due diligence or title verification. Physical verification, including visits to revenue offices and obtaining certified copies of records, remains a crucial part of the process. In summary, my experience reaffirmed that despite advancements in digital record-keeping, thorough due diligence still relies heavily on physical verification and localized administrative engagement, especially when dealing with the diverse legal and regulatory challenges across different jurisdictions. #landduediligences #titlesearches #realestate #realestatedd #lifeoflawyer #HammurabiandSolomon Aeshwarya Sisodia

  • The Competition Commission of India (CCI) has imposed a ₹213-crore penalty on Meta, citing abuse of dominance through WhatsApp’s 2021 Privacy Policy. This ruling addresses anti-competitive practices in digital markets, emphasizing fairness and consumer protection. The CCI identified Meta's dominance in Over-the-Top (OTT) messaging and online display advertising. WhatsApp’s Privacy Policy, which mandated data sharing with Meta, was deemed unfair, restricting user choice and reinforcing monopolistic practices. As part of the ruling, Meta must revise the policy to allow users the option to opt out of data sharing for advertising and is restricted from leveraging WhatsApp user data for advertising purposes for five years. The decision aligns with the principles of the The Digital Personal Data Protection Act, 2023 (DPDP Act), emphasizing the importance of transparent, user-consent-based data practices. It also highlights the growing intersection of competition law and data privacy law, setting a precedent for fair market competition and responsible data-sharing. Meta has indicated plans to appeal the decision, but the ruling has been widely welcomed as a step toward safeguarding consumer rights and fostering competition in the digital economy.     Had an insightful experience attending the NextGen Legal Rumination Summit organized by CCAI from November 15th to 18th at Munnar, Kerala, where the ambitious goal of India becoming a 30 trillion-dollar economy by 2047 was discussed. The discussions explored the multifaceted role of the legal profession in achieving this milestone. It was great to hear Shweta Bharti Manish Lamba Deepika Chaudhry Karan Singh Chandhiok and many others. Further, the discussions delved into the intersection of data privacy, artificial intelligence, and the role of the legal framework. Concerns about the potential challenges in enforcing data privacy and artificial intelligence laws in India, that are largely adaptations of Western models were highlighted and valuable inputs were provided by the speakers Shantanu Malik Lajita Rajesh Swastica Goswami Mirul Bhavsar Pranav Mehra Mohit Kapoor and many others. As India navigates this complex terrain, striking a balance between innovation and regulation will be crucial. Looking forward to meeting all the legal luminaries present at the event very soon.
