In January 2020, the primary accused followed a minor girl and expressed his desire to marry her, despite her rejection and her mother's intervention. The harassment escalated, and in August 2020, the accused allegedly trespassed into the girl's home, assaulted her, while a second accused stood guard outside. The trial court convicted both men on multiple charges under the IPC and the POCSO Act, including stalking, sexual harassment, and criminal intimidation. Upon review, the Bombay High Court ruled that a single instance of following did not meet the legal criteria for stalking under Section 354(D) of the IPC, which requires repeated or persistent behavior.
