Art&Law in a nutshell Generative AI: first lawsuits in Europe Generative AI is also starting to cause litigation in Europe for copyright infringement. GEMA - a German collecting society representing the copyrights of more than 95,000 members in Germany and over two million rights holders worldwide- recently filed a lawsuit against OpenAI, the world leading provider of generative AI, for using protected musical works of many German authors. On November 13, GEMA brought an action before Munich Regional Court representing its member’s rights against OpenAI LLC, the American parent company, and OpenAI Ireland Ltd., the subsidiary operating in Europe. Digital Service Act and Digital Market Law: private international law outlines Paola Gelato, in cooperation with Giovanni Pira, will give a remote lecture on Digital Service Act and Digital Market Law as part of the course on International Private and Procedural Law held by Professor Margherita Salvadori at the Università degli Studi di Torino on 21 November. During the lecture, the issues of the DSA and the DMA will be illustrated, focusing on the protection of consumers, in particular minors and vulnerable persons, as well as the limitation of dominant positions of large platforms. In addition, the issues of applicable law and jurisdiction in the context of e-commerce will be discussed. This will be done by applying the general rules of international private law in combination with the specific provisions by DSA and DMA Regulations.
