The rain came down in buckets, shoes got a little muddy, but what’s a Koroga without a little adventure, right? The apex court of the land, Supreme Court of Kenya has on this 29th Day of October 2024 declared the Finance Act 2023 constitutional and valid, thereby setting aside the finding of the Court of Appeal. The Supreme Court however upheld the decision of the Court of Appeal as to the following provisions of the Finance Act: 1. The question of Affordable Housing Levy introduced by the Finance Act 2023 which was declared moot by the Court of Appeal owing to the introduction of the Affordable Housing Levy Act. 2. Sections of the Finance Act amending the Kenya Roads Act and the Unclaimed Financial Assets Act, which were declared unconstitutional by the Court of Appeal as these provisions were not incidental or directly connected to the money bill (Finance Act). To this extent, status quo remains the same and the Finance Act 2023 is in force and operational as enacted.
