    #ANNOUNCEMENT |🚨Interlaw Appoints Board Director from Mauritian Partner Firm   What an absolute privilege for Juridis Law Firm 🇲🇺to announce that Senior Partner, Johanna Murugan, has been appointed to the board of directors of Interlaw Ltd. 🌐   Co-founder of our law firm, Johanna is a Barrister-at-Law and is qualified to practice in Mauritius and France. With over 12 years’ experience in civil and commercial legal practice, she specializes in real estate, financial services and corporate law.   She regularly advises on cross-border transactions, acting for companies including banking and non-banking financial institutions, property developers and local and international investors who wish to structure their investment and businesses through Mauritius.   Johanna is also actively involved with international and local NGOs, acting as pro bono Counsel and board member, and is a Professor of Property Law at the International Law School of the Universiteì Pantheìon-Assas in Mauritius.   Commenting on her appointment, Johanna said:   “Since Juridis joined Interlaw in 2023, I have had the pleasure of meeting and working with many of our colleagues across the world, experiencing first-hand the culture of collaboration that sets the network apart.     🚨#Mauritius Gears Up for General Election 🗳️ Mauritius 🇲🇺 is heading towards yet another milestone in its democratic journey, with the general election set for November 10, 2024, following the dissolution of the National Assembly on October 4. As the island nation prepares for another electoral cycle, it showcases the resilience of its democratic institutions and the stability that has made it a beacon of democracy in Africa. Since gaining independence in 1968, Mauritius has maintained a tradition of regular, free, and fair elections. This commitment to democratic principles has been pivotal to the nation's political and economic stability. Despite being a small island state with a diverse population, Mauritius has consistently ranked high on global democracy indices, reflecting the strength of its governance framework and public institutions. The upcoming election marks yet another opportunity for Mauritians to engage in the democratic process and choose their representatives. It highlights the country's well-established culture of political pluralism, where a range of parties and alliances compete for power. Two major political alliances are set to dominate the electoral landscape: Alliance Lepep, led by the current Prime Minister Pravind Jugnauth and the Mauritius Socialist Movement (MSM), aims to secure another term by continuing its agenda on economic growth and infrastructure development. The alliance has governed Mauritius over the past five years, focusing on modernization projects and social welfare initiatives. Alliance du Changement, comprising the Labour Party (PTr) led by Dr. Navin Ramgoolam and the Mauritian Militant Movement (MMM) headed by Paul Bérenger and other coalition parties, presents itself as a reformist alternative, promising a change in governance that addresses citizens' concerns about public sector management and economic disparity. In addition to these main alliances, several smaller parties and independent candidates will participate, reflecting the country's dynamic political scene. Despite numerous economic and social challenges, Mauritius' ability to hold regular elections and ensure peaceful transfers of power has solidified its reputation as a resilient democracy. The country's multi-ethnic and multi-religious society has managed to maintain social harmony, with democratic processes playing a central role in addressing grievances and fostering inclusion. Mauritius has a history of high voter turnout, demonstrating the public's commitment to the democratic process and Mauritians' active engagement and trust in the democratic system. This engagement contributes to the legitimacy of electoral outcomes and reinforces the country's democratic foundation.     🚨CASE IN POINT: Understanding the Timeline for Misconduct Charges In its latest decision, the Supreme Court of Mauritius in CIM Finance Services Ltd v. Nayantara Ramessur (2024 SCJ 453) reaffirmed a key principle regarding the timing of employer actions under the Employment Rights Act 2008. The central issue revolved around the interpretation of section 38(2)(a)(iii) concerning the requirement for employers to notify employees of charges related to misconduct within ten days of becoming aware of the misconduct. The Court of Appeal agreed with the principles established in earlier cases, emphasizing that the ten-day delay under section 38(2)(a)(iii) begins only when the employer has a "connaissance exacte et complète des faits reprochés"—a precise and complete understanding of the alleged facts.    In this case, it was deemed that such knowledge could only be established upon the completion of an internal enquiry.   The judgment overturned the Industrial Court's decision, which found the employer at fault for not notifying the employee within the statutory delay. The Supreme Court concluded that the enquiry was completed on 18 April 2013, and the charges were correctly issued thereafter, hence the employer had complied with section 38(2)(a)(iii). The appeal was allowed, and the order for severance allowance was quashed.

    As part of the EMEA 2024 conference in July, DELTA legal collaborated with Interlaw‘s charity group Interlaw Ltd. Cares to host a volunteer event at the Don Bosco Church Speech Therapy Primary School. Despite its valuable contributions to the community, the school is struggling with outdated facilities and lack of funding. Aside from a financial donation, we managed to mobilize over 40 volunteers, with one group undertaking manual tasks and another engaging with students through presentations on their home countries. ⛏ 🗜 📝 We are grateful to the headmistress Daniela Špinková and the entire school for this opportunity to support their mission and forge a lasting partnership! 😊 See how the day unfolded in the attached video:
