At the Amsterdam Centre for Transformative Private Law (ACT) we explore the role of private law in the making of society. Private law is always transformative: Every articulation of rights and duties - enabling some forms of action and cooperation as opposed to others - always entails a political choice, with vast impacts on the economy and society. The critical-analytical project behind Transformative Private Law works to grasp how contemporary categories of private law (e.g. contract, property, corporation, tort) and the principles on which they are based (such as privity of contracts, shareholder primacy, causality, liability) empower some actors over others and eventually entrench outcomes that are harmful or unjust. By identifying the ways in which private law entrenches injustice, or aggravates societal challenges, we aim to identify sites of intervention and articulate pathways to alternative private law frameworks. This joint academic ambition is addressed through pluralistic methodological approaches represented within ACT, including both robust doctrinal analysis and transdisciplinary engagements with, for instance, philosophy, social theory, political economy, economics or sociology. ACT welcomes a multiplicity of different perspectives and (counter)narratives and especially those that are often unheard of, or remain significantly underexposed.

With the conference today and yesterday that I organized with prof. Aukje van Hoek and prof. Ianika Tzankova we aimed to bring practitioners and academics together in having quality discussions around academic papers, in the rapidly evolving field of class actions in environmental, social and governance (ESG) matters. I think we succeeded! In any case, we had interesting discussions on a wide range of topics, from funding and representation to jurisdiction and applicable law, and from corporate sustainability and data protection to reparation for war damages in Ukraine and the downsides of carbon markets for local indigenous communities. A special issue with many of the papers is forthcoming in the Mass Claims Journal. Dear friends, DOWNLOAD OPEN ACCESS BOOK "Re-imagining Prosperity: Toward a New Imaginary of Law and Political Economy in the EU" (Cambridge University Press, 2024). Thanks to so many people, without whose generous help this book would not have seen the light of the day. The book argues that the historic task of the European Union (EU) today is to articulate and institute a new imaginary of prosperity. Imaginaries of prosperity integrate societies around the shared pursuit of a prosperous future, rendering 'political-economic' questions as the main preoccupation of politics. The new imaginary of prosperity in the EU must be able to provide answers to contemporary societal challenges while also conjuring a world in which people want to live. Through analyses of several policy fields, the book shows that the EU has already made modest strides in fostering more caring consumption, circular products and technologies, sustainable industry, and fairer corporate activity. But the EU must go further and faster if it hopes to respond effectively to Europe's problems, while arresting another descent into tribalism. Met plezier kijk ik terug op het colloquium over het nieuwe Belgische verbintenissenrecht vanuit Nederlands perspectief, georganiseerd aan de Universiteit van Amsterdam.🇧🇪🇳🇱 Het was een boeiende namiddag waarin de verschillende rapporten duidelijk maakten dat de Nederlandse ervaring, na meer dan 30 jaar toepassing van het Nederlands BW, waardevolle inzichten biedt voor de toepassing van enkele nieuwe wetsbepalingen in België.
