About us
The BFSLA connects members with ideas. We were established in 1983 to share information on banking law and practice and since then, have expanded to encompass financial services and insolvency law. Our aim is to provide thought leadership on issues relevant to our members through connecting with some of the world’s leading practitioners, academics, regulators and members of the judiciary. As well as providing deep insight into technical legal issues we also pride ourselves on giving practical guidance on how things work in the real world as we recognise that excellence in banking & financial services and insolvency law is more than just an understanding of the black letter law. Our members are lawyers and insolvency practitioners from law firms, banks, financial institutions, trustee companies and insolvency firms at all stages of their career. Our Future Leaders Committee supports members who are just starting out in banking & financial services and insolvency to help them navigate their way through the legal landscape and achieve their full potential. Each year our marquee event is to hold the leading conference for banking & financial services and insolvency law in Australia and New Zealand. In recent years we have been privileged to have such leading jurists as Lord Neuberger, President of the Supreme Court of the United Kingdom, Lord Hoffman, Lord Hope, Judge Peck (who presided over the Lehman Brothers insolvency), Professor Philip Wood, Chief Justice Sian Elias, Justice Dyson Heydon and Justice Gageler. Members of our Conference Planning Committee work tirelessly to ensure that we have world class speakers on topics that are relevant to our members. In particular, we carefully select the program to ensure that we have a balance of sessions dealing with technical legal issues and practical topics. The annual conference is also a great opportunity for members to get together in a relaxed environment to share ideas and knowledge.

Congratulations to Dayle Buckley, BFSLA scholarship recipient for 2023 who graduated from Cambridge in July 2024. Dayle graduated with first class honours and came 18th out of 230 LLM students. The final session of the 40th annual BFSLA conference was an anniversary retrospective of the last 4 decades of the association. The panel chaired by Dr Nuncio D'Angelo Norton Rose Fulbright offered their perspectives on the changes over the last 40 years and their predictions for the future. There were a few light moments!! The last concurrent session of day 2 for the 40th Annual BFSLA conference was "Tokenising financial and investment assets: is it a thing?" Using a case study approach, this session explored key regulatory and transaction considerations when dealing with tokenised assets, including financial services law implications, challenges with taking security and more. BFSLA 40th annual conference session "Making distressed workouts work for directors: a cross-Tasman comparison on approaches to managing insolvent trading and wrongful trading risks" with chair Josh Cairns Simpson Grierson and joined by speakers Scott Abel Buddle Findlay, Joe Hayes Wexted Advisors and Orla McCoy Gilbert + Tobin. This session offered a comparative analysis of New Zealand's wrongful trading regime and Australia's insolvent trading laws and practical strategies to assist directors to steer financially distressed businesses through turnaround scenarios.
