A few days ago, our colleague Cristina Tudoran participated in the EELA – 𝐄𝐑𝐀 𝐀𝐧𝐧𝐮𝐚𝐥 𝐒𝐞𝐦𝐢𝐧𝐚𝐫 𝐨𝐧 𝐄𝐔 𝐋𝐚𝐰 held in Brussels. Here are some of the key takeaways from this insightful event: 1️⃣ 𝐏𝐥𝐚𝐭𝐟𝐨𝐫𝐦 𝐖𝐨𝐫𝐤 𝐃𝐢𝐫𝐞𝐜𝐭𝐢𝐯𝐞 💡 𝐖𝐇𝐀𝐓: Since October 2024, we now have a Platform Work Directive aimed at properly qualifying the relationships between platforms and workers (e.g., food delivery, drivers, crowdwork). 💡 𝐇𝐎𝐖: 𝐓𝐡𝐞 𝐟𝐚𝐜𝐭𝐬 𝐬𝐡𝐚𝐥𝐥 𝐩𝐫𝐞𝐯𝐚𝐢𝐥: if control is proved, there is a 𝐩𝐫𝐞𝐬𝐮𝐦𝐩𝐭𝐢𝐨𝐧 𝐨𝐟 𝐞𝐦𝐩𝐥𝐨𝐲𝐦𝐞𝐧𝐭 𝐫𝐞𝐥𝐚𝐭𝐢𝐨𝐧𝐬𝐡𝐢𝐩. Member States will determine what facts indicating control and direction trigger the legal presumption. Earlier proposals referring to an algorithm-based approach were dropped in the final version. 💡 𝐖𝐇𝐄𝐍: The deadline to transpose the Directive is 2 December 2026. 2️⃣ 𝐖𝐡𝐢𝐬𝐭𝐥𝐞𝐛𝐥𝐨𝐰𝐢𝐧𝐠 𝐚𝐧𝐝 𝐆𝐃𝐏𝐑 𝐂𝐨𝐧𝐬𝐭𝐫𝐚𝐢𝐧𝐭𝐬 🚨 When dealing with whistleblowing cases, it’s crucial to take note of the GDPR constraints for all individuals involved: Anonymize personal data when sharing information with the complainant, perpetrator, or witnesses. Ensure confidentiality, transparency, and respect the right to access. Today, something truly special happened in our building. We hosted our first 𝐑𝐞𝐬𝐚𝐥𝐞 𝐟𝐨𝐫 𝐆𝐨𝐨𝐝 event right in the reception area. Together with our wonderful colleagues and the Skanska team, we collected clothes and books and gave them a second life by putting them up for sale. The best part? All the funds we raised will go straight to Asociația 𝐌𝐚𝐠𝐢𝐜, helping them continue their incredible work. A huge thank you to everyone who brought items, stopped by, or supported us in any way. Regulamentul UE privind Inteligența Artificială a intrat în vigoare pe 1 august 2024, urmând ca majoritatea prevederilor să devină aplicabile din 2 august 2026, iar unele aspecte chiar din 2025. Acest cadru normativ impune obligații clare pentru operatorii economici și utilizatorii de sisteme de AI din UE, inclusiv pentru angajatori care folosesc AI în recrutare sau în relația cu angajații. Our colleague George Domocoș has once again contributed to the prestigious 𝐑𝐨𝐦𝐚𝐧𝐢𝐚𝐧 𝐀𝐫𝐛𝐢𝐭𝐫𝐚𝐭𝐢𝐨𝐧 𝐉𝐨𝐮𝐫𝐧𝐚𝐥. His latest article, titled "𝘊𝘰𝘳𝘳𝘶𝘱𝘵𝘪𝘰𝘯 𝘢𝘯𝘥 𝘪𝘵𝘴 𝘌𝘧𝘧𝘦𝘤𝘵𝘴 𝘪𝘯 𝘐𝘯𝘵𝘦𝘳𝘯𝘢𝘵𝘪𝘰𝘯𝘢𝘭 𝘈𝘳𝘣𝘪𝘵𝘳𝘢𝘵𝘪𝘰𝘯, 𝘸𝘪𝘵𝘩 𝘍𝘰𝘤𝘶𝘴 𝘰𝘯 𝘙𝘰𝘮𝘢𝘯𝘪𝘢", is based on his LLM dissertation and provides a deep dive into the complex relationship between international arbitration and corruption.
