𝐀𝐝𝐯𝐚𝐧𝐜𝐢𝐧𝐠 𝐫𝐞𝐧𝐞𝐰𝐚𝐛𝐥𝐞 𝐞𝐧𝐞𝐫𝐠𝐲 𝐢𝐧 𝐑𝐨𝐦𝐚𝐧𝐢𝐚 ⚡ According to information provided by National Energy Regulatory Authority (ANRE), as of 1 October 2024, Romania has an impressive 1,153 renewable energy projects with evacuation capacities of at least 1 MW approved for grid connection. This represents a 3.78% increase in project approvals since September, 𝐝𝐞𝐦𝐨𝐧𝐬𝐭𝐫𝐚𝐭𝐢𝐧𝐠 𝐚 𝐜𝐨𝐦𝐦𝐢𝐭𝐦𝐞𝐧𝐭 𝐭𝐨 𝐬𝐮𝐬𝐭𝐚𝐢𝐧𝐚𝐛𝐥𝐞 𝐝𝐞𝐯𝐞𝐥𝐨𝐩𝐦𝐞𝐧𝐭 𝐚𝐧𝐝 𝐞𝐧𝐞𝐫𝐠𝐲 𝐫𝐞𝐬𝐢𝐥𝐢𝐞𝐧𝐜𝐞. With a total of 52,778 MW of approved capacity, an increase of 2.97% month-on-month, these projects represent a solid step towards Romania's renewable energy targets. In addition, 560 projects now have grid connection contracts (up 9.8% since September) and 312 projects have received construction authorizations, an increase of 26.32%. Notably, 23 projects (with a combined capacity of 1,190 MW) 𝐢𝐧𝐜𝐨𝐫𝐩𝐨𝐫𝐚𝐭𝐞 𝐞𝐧𝐞𝐫𝐠𝐲 𝐬𝐭𝐨𝐫𝐚𝐠𝐞 𝐟𝐚𝐜𝐢𝐥𝐢𝐭𝐢𝐞𝐬, 𝐫𝐞𝐢𝐧𝐟𝐨𝐫𝐜𝐢𝐧𝐠 𝐠𝐫𝐢𝐝 𝐬𝐭𝐚𝐛𝐢𝐥𝐢𝐭𝐲. Nine of these are on track for commissioning within 2024, underscoring advancements in renewable energy storage. 💡𝐆𝐚𝐫𝐝𝐚 𝐝𝐞 𝐌𝐞𝐝𝐢𝐮: Schimbări importante aduse atribuțiilor și competențelor Garda Națională de Mediu („𝐆𝐍𝐌”) este corpul specializat de inspecție și control aflat în subordinea autorității publice centrale pentru protecția mediului. Prin intermediul comisarilor săi, GNM are puterea de a impune măsuri de sancționare, suspendare sau sistare a activităților în cazul încălcărilor privind poluarea, deteriorarea mediului sau nerespectarea condițiilor stabilite prin autorizații și acorduri de mediu. ✨Anul 2024 a marcat o etapă importantă de reorganizare pentru autoritățile de mediu din România. Adoptarea Ordonanței de urgență nr. 103/2024 privind reorganizarea instituțiilor din domeniul mediului, apelor și pădurilor, a dus la înființarea Agenției Naționale pentru Mediu și Arii Protejate. Acum, procesul de restructurare a ajuns la GNM, în scopul implementării prevederilor Legii nr. 296/2023 privind măsurile fiscal-bugetare necesare pentru asigurarea sustenabilității financiare a României pe termen lung. În acest sens, proiectul de Hotărâre de Guvern aflat în transparență decizională pentru modificarea Hotărârii Guvernului nr. 1005/2012 propune o serie de schimbări de interes în ceea ce privește organizarea, competențele și procedurile GNM, printre care: ➥creșterea capabilității operative a GNM, prin reducerea numărului total de posturi, urmată de angajarea a 150 de noi comisari specializați în inspecție și control, pentru a îmbunătăți răspunsul operațional pe teren; ➥reglementarea inspecțiilor pe timp de zi și noapte și acoperirea mai multor tipuri de locații; ➥posibilitatea de a preleva probe, mostre și de a efectua măsurători cu aparatura din dotare sau de a solicita expertize tehnice necesare finalizării inspecției; ➥completarea reglementărilor preexistente privind confiscarea, inclusiv atribuirea unei rubrici destinate în procesul-verbal de contravenție; ➥verificarea și aplicarea de sigilii, în scopul stabilirii respectării dispozițiilor legale în domeniul protecției mediului; ➥extinderea atribuțiilor în domeniul biodiversității și al ariilor naturale protejate, în sensul reglementării controlului respectării reglementărilor privind trasabilitatea, importul/exportul și comercializarea/deținerea/scoaterea de pe teritoriul țării de specii din flora și fauna sălbatică, inclusiv în stare vie sau moartă, precum și a oricăror părți și produse ale acestora; ➥dotarea comisarilor cu înregistratoare audio-video portabile de tip body worn camera și camere video de bord; ➥posibilitatea desfășurarea acțiunii de control cu un singur comisar, în loc de doi, atunci când aceasta are loc în colaborare cu agenți constatatori din alte instituții autorizate; Restructurările și extinderea competențelor GNM atrag tot mai mult interesul titularilor de autorizații de mediu și al companiilor implicate, subliniind importanța unei monitorizări continue a obligațiilor și a schimbărilor legislative.

𝐑𝐞𝐭𝐚𝐢𝐥 𝐬𝐞𝐜𝐭𝐨𝐫 𝐟𝐚𝐜𝐞𝐬 𝐆𝐃𝐏𝐑 𝐜𝐡𝐚𝐥𝐥𝐞𝐧𝐠𝐞𝐬 Yesterday, the Romanian Data Protection Authority (DPA) announced a €10,000 fine for a retailer due to breaches of the lawfulness, fairness, and transparency principles, as well as accountability principles under GDPR. Additionally, a warning was issued for security breaches concerning personal data. The controller 𝐮𝐧𝐥𝐚𝐰𝐟𝐮𝐥𝐥𝐲 𝐬𝐡𝐚𝐫𝐞𝐝 𝐜𝐨𝐩𝐢𝐞𝐬 𝐨𝐟 𝐞𝐦𝐩𝐥𝐨𝐲𝐞𝐞𝐬' 𝐈𝐃 𝐜𝐚𝐫𝐝𝐬 𝐰𝐢𝐭𝐡 𝐚 𝐬𝐞𝐫𝐯𝐢𝐜𝐞 𝐩𝐫𝐨𝐯𝐢𝐝𝐞𝐫, leading to unauthorized access to personal data, including names, ID numbers, addresses, and photographs. 📢𝐊𝐞𝐲 𝐭𝐚𝐤𝐞𝐚𝐰𝐚𝐲: Before processing personal data, controllers must identify the legal basis and ensure compliance with at least one of the provisions in Article 6(1) GDPR. Notably, legitimate interest can serve as one such legal basis. 𝐓𝐡𝐞 𝐆𝐃𝐏𝐑 𝐝𝐨𝐞𝐬 𝐧𝐨𝐭 𝐩𝐫𝐢𝐨𝐫𝐢𝐭𝐢𝐳𝐞 𝐚𝐧𝐲 𝐥𝐞𝐠𝐚𝐥 𝐛𝐚𝐬𝐢𝐬 𝐨𝐯𝐞𝐫 𝐚𝐧𝐨𝐭𝐡𝐞𝐫. The European Data Protection Board (EDPB) recently provided a draft version for the guidelines for processing personal data based on legitimate interest (Guidelines 1/2024 on processing of personal data based on Article 6(1)(f) GDPR, in public consultation until 20 November 2024).
