Canada’s mining industry is one of the largest globally, producing over 60 minerals and metals. With $4.1 billion generated from mineral exploration and precious metals accounting for 61% of this spending, it’s no surprise that investors are eager to tap into this lucrative sector. The mining industry has increasingly integrated Indigenous knowledge and perspectives, ensuring alignment with sustainable mining practices. Currently, over 500 active agreements exist between mining companies and Indigenous communities, demonstrating a strong commitment to mutual respect, environmental stewardship, and long-term collaboration. A recent example highlights this complexity: the Tsetsaut Skii km Lax Ha (TSKLH) Nation has filed a petition for a judicial review of Seabridge Gold Inc.’s KSM gold-copper project, located on territory TSKLH still claims as its own. While Seabridge has complied with the British Columbia Environmental Assessment Office (BC EAO) application process, TSKLH argues that both the government and Seabridge failed to meet their obligations under the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP). Their concerns focus on inadequate consultation and the potential impact on natural waterways critical to their food systems and cultural practices. Many operate on the Treaty, Settlement, Traditional, and unceded territories of Indigenous Peoples without fully realising that this goes beyond traditional and cultural considerations; it also carries significant legal implications. Honouring treaties, engaging in meaningful consultation, and ensuring that development aligns with both legal obligations and the principles of equity and justice build trust, accountability, and long-term investment.
