  • The FDA will no longer allow for the use of FD&C Red No. 3 in food and ingested drugs based on a study showing thyroid cancer in male rats, and subsequently citing the Delaney clause. Manufacturers who use FD&C Red No. 3 in food and ingested drugs will have until January 15, 2027 or January 18, 2028, respectively, to reformulate their products.

  • ECHA has updated its guidance on the application of the EU Classification, Labelling and Packaging (CLP) Regulation. In particular, the guidance now contains the new hazard categories which were implemented with an amendment to the EU CLP Regulation.   • On 12 November 2024, the Scientific Committee on Consumer Safety (SCCS) published its draft opinion on ethylhexyl methoxycinnamate (EHMC). For more information on the mandate, please see the link below. In the draft, the SCCS stated that they could not determine the safety of EHMC due to insufficient data to rule out genotoxicity. Additionally, the evidence indicates that EHMC exhibits endocrine activity, as it has been shown to have estrogenic effects and weak anti-androgenic effects in both in vitro and in vivo studies.   • The REACH microplastics restriction will be enforced in Northern Ireland. The European Commission is amending Annex XVII of REACH within the EU. This amendment pertains to the marketing or use of synthetic polymer microparticles. The EU REACH restriction affects any synthetic, solid, non-biodegradable polymer used in cosmetics. This legislation does not apply to the GB market, which has adhered to UK REACH since January 1, 2021. However, to maintain access to the EU single market, Northern Ireland follows certain EU regulations concerning chemicals, including REACH. Consequently, the restriction will be applicable in Northern Ireland. Products containing synthetic polymer microparticles marketed in Northern Ireland must comply with the limits set by the updated Regulation. The Department for Environment, Food and Rural Affairs (Defra) has released an explanatory memorandum detailing the new requirements and their application in the UK and Northern Ireland.   • The Office for Product Safety and Standards (OPSS) has recently reminded the cosmetics industry to dispose of any cosmetics that contain the banned ingredient Lilial. This alert is part of the UK’s ongoing efforts to ensure the safety of cosmetic products available in the market. Because its use has been associated with harm to the reproductive system and subsequent classification as a Repro 1B, it has been illegal to sell any product containing Lilial in Great Britain since December 2022.

  • The Department for Environment, Food and Rural Affairs (Defra) has issued the following announcement regarding the recyclability labelling mandated by the UK Extended Producer Responsibility (EPR) regulations: “We want to provide you with an update on the legislation for the introduction of Extended Producer Responsibility for packaging reforms. This legislation is on track to come into force in January 2025 as planned.  In the process of finalising this legislation we have taken a decision relating to the proposed provisions on labelling.  We have removed the provisions from the Statutory Instrument that relate to the introduction of mandatory labelling. However, this is a temporary position. The UK Governments (England, Northern Ireland, Scotland and Wales) remain committed to a mandatory labelling regime to make it easier for consumers to understand how to recycle packaging correctly, and ultimately for the scheme to deliver its environmental outcomes.  We will include mandatory labelling across the UK - likely via an amendment to our forthcoming legislation in 2025 - and our approach is likely to be consistent across all nations of the UK. In preparing these provisions, we will review the forthcoming EU packaging legislation (EU Packaging and Packaging Waste Regulation) and explore the potential for consistency across our approaches. We will seek to minimise the costs and complexity of the arrangements for those businesses trading across all these markets, while protecting our commitment to the importance of labelling as part of the overall objectives of these reforms.  In parallel, we will continue to pursue work to ensure citizens across the UK understand how to recycle their waste to best effect. Clarity and communication to citizens is a key part of delivering the Collection & Packaging Reforms overall.”
