Incoterms…. Yay fun…. In theory everything is settled by the guidelines…. However somehow they are „adjusted“ all the time… EXW but the shipper provides the MRN…(turning it into FCA) etc…. But let’s talk about the „silent killer“ DDP… As per the book the shipper pays for everything including duty and taxes… sounds simple but in most cases the shipper doesn’t have a fiscal presence in the country of destination, therefore can’t act as importer of record… and DDP is no longer an option…. However many smart people decided that they could just add „except duty and taxes“ to the term.. and everything is fine… Until one day the books are checked and the surveyors from the tax department, see that the consignee has always acted as importer of record and than reclaimed the VAT…. But all the import invoices show „DDP“…. The conclusion.. the consignee is fined based on tax fraud charges, and has to return all the reclaimed funds along with a hefty fine…. I have seen this play out just like this… there is a reason why all documents must be kept for 10 years…. See when it comes to customs, the world is strictly black and white….
