Equal Representation for Expert Witnesses

Equal Representation for Expert Witnesses (ERE) aims to improve the representation of women as expert witnesses.
About us
The Equal Representation for Expert Witnesses (ERE) initiative was launched in 2022 to bring a drive commitment to improve the representation and visibility of women as expert witnesses. ERE was created to be a sister pledge to the Equal Representation in Arbitration Pledge (ERA), which has been highly effective since its inception in 2015, calling for – and seeing – an increased proportion of women appointed as arbitrators. Developed with input from across dispute resolution, and on both sides of The Atlantic, the Pledge aims to encourage action and advocacy to: • To increase, on an equal opportunity basis, the number of women appearing as experts in order to achieve proportional representation and, eventually, full parity. • To support hiring, mentoring, and promoting women experts; • To create a coalition of supporters and advocates in the world of dispute resolution • To encourage women to aspire to be expert witnesses in their chosen professions • To give women who are, or aspire to be, expert witnesses, better opportunities to achieve their goals. • To widen the pool of expert witnesses available and enhance the reputation of expert witnesses The ERE initiative seeks to address the challenges faced by women who work, or aspire to work, as expert witnesses in all forms of dispute resolution globally. Let’s commit and drive change.

The French branch of ERE held a cocktail in the heart of Paris, at the beautiful gardens of White & Case LLP. The cocktail was opened by Kirsten Odynski on behalf of the host. Kirsten directed audience’s attention to the positive messages of the ERE’s recent survey in terms of report drafting while highlighting that the survey showed that female experts have yet to achieve parity with their male counterparts. Kirsten drew interesting parallel with the upcoming Olympic Games in Paris, where parity will be finally achieved after more than 124 years, wishing female experts to achieve this parity much earlier than that. Jana Lefranc reported on actions undertaken by the French branch of ERE over the last year, including partnership with #PAW2024. She appealed to the audience to use gender diversified short lists when selecting experts, a feature popular with participants in the aforementioned survey. She also presented a brochure with bios of all female experts present at the cocktail. Sophie Nappert (snappert@3vb.com), a well-known arbitrator, encouraged female experts to be pragmatic about the reality of clients putting diversity at the top of their agenda and take advantage of the current requirement for gender diversity, highlighting that in this way they obtain an excellent opportunity to demonstrate their capabilities and prove that the client’s choice was right. Sophie further encouraged ERE to pursue collection of statistics including information on sectors in which the experts practice. On behalf of the French branch of ERE, we would like to thank all participants for their support and we hope they enjoyed the evening as much as the French ERE group did.

The ERE Survey 2024 report reveals a growing desire among legal professionals to effect change – and a burgeoning pipeline of aspiring expert witnesses – notwithstanding a lack of tangible progress in the number of women taking the witness stand. Our 2024 survey once more obtained a terrific response, with 363 respondents from 23 countries, helping us to better understand the challenges facing female experts and identify potential solutions.
