Can the right to counsel be considered an optional Right within the European legal framework, to the extent that a European Arrest Warrant may be executed based on a national conviction issued in the absence of any legal counsel for the accused? In Italy, the right to defense is inviolable, as explicitly guaranteed by constitutional provisions, and one can only hope that harmonization efforts across Europe aim to enhance the rights of all European citizens. This matter will be discussed today before the Supreme Court of Cassation, with the support of amici curiae European Criminal Bar Association and Fair Trials.

We support the ECBA's call for the new Secretary General to: 👉🏼 𝐄𝐧𝐝 𝐌𝐢𝐬𝐮𝐬𝐞: Put firm checks in place to prevent and address unjust Notices. ❗ On the eve of INTERPOL’s General Assembly, the European Criminal Bar Association calls on the organisation and member countries to reaffirm their commitment to upholding human rights standards. 🌎 The #ECBA emphasises that fundamental rights, due process, and fair trial standards are crucial to the functioning of a system of international cooperation in criminal matters. https://lnkd.in/dmN9E2ki #INTERPOL #Humanrights #Fairnessincriminaljustice #Europeancriminallawyers Valdecy Urquiza

  • We are pleased to announce that our Senior Legal Officer, Chryssa Mela, will be speaking about our INTERPOL and Red Notices campaign at the "Transnational Threats to Journalists in the European Landscape" webinar on October 31st, organized by Media Defence and Free Press Unlimited. Fair Trials has long campaigned for INTERPOL to take stronger action to prevent its systems from being abused by countries worldwide to persecute journalists, refugees, and peaceful political activists. These systems, particularly its international "wanted persons" alerts, known as Red Notices, and its less formal alerts, called diffusions, are frequently misused by authoritarian countries to target these groups. While our campaign was successful, there is still much work to be done. Please register here to attend the webinar: bit.ly/3YzIBCV
