Members of our French desk were pleased to present at Image 7 in Paris last week on the different issues keeping our clients up at night. Our Family Team has almost tripled in size in the past year. The team is at the forefront of family legal issues, pushing the boundaries of and re-shaping family law, as modern families continue to evolve.   12 months ago, we hired partners Catherine Costley and Joshua Moger from the family team at Payne Hicks Beach, to join our highly regarded partners Teresa Cullen and Hetty Gleave. We were thrilled to be a part of and attend a night of commemoration and celebration, honouring 360 years of the Royal Marines’ unparalleled service, at the Royal Marines Charity Guildhall Dinner. Partners Gideon Dabby-Joory, Antonia Torr, David Harrison and Nathan Carter-Smith were joined by Chris Taylor, Jacob Sandelson, Sam Navazesh, James Hall and Scott Robert Willis to pay tribute to the remarkable legacy and embrace a future of continued excellence.

We were thrilled to attend Munich Restructuring Forum earlier this week. Our restructuring & insolvency partner Sophie Burke joined panellists Christine Borries, LL.M.(USYD), Michael Cherubim & Denise Jagmetti, to discuss ‘Insolvency without borders: How we master non-EU cases in Germany and vice versa.’ The panel was moderated by Dr. Robert Hänel and Andreas Dimmling. Sophie commented: “It was a privilege to take part in such a lively and entertaining discussion with Andreas, Robert and my co-panellists and to compare the different approaches taken in the UK, Switzerland and USA. I was also very happy to be back in Germany and Munich is a city that never disappoints!”

Creation of a modern family: Fladgate secures successful parental order in international surrogacy arrangement.   Hetty Gleave and Rebecca Christie in our Family Team, in collaboration with Antonia Torr, from our Immigration Team, instructed Andrew Powell of 4PB in Re F [2024] EWHC 2849 (Fam).   With modern families continuing to evolve, we’re committed to supporting domestic and international families navigate complex family legal issues. This case demonstrated great teamwork between Antonia, Hetty and Rebecca, who worked together to successfully secure a Parental Order following the birth of a child through an international surrogacy arrangement. A special thank you to Andrew Powell who represented the applicants with skill and compassion.   Mr Justice Hayden noted that he was “delighted to make a Parental Order in respect of F, who has attended court with his parents, whom the law now, by virtue of my (his) order, recognises as such. Leading the way for Forma Real Estate Funds.   We recently advised Forma Real Estate in connection with the acquisition of a mixed-use prime property on 19-31 Piccadilly, Manchester, from L&G Real Estate for approx. £23.5m.   Forma is a pan European commercial real estate fund manager.  Since the launch of its first fund in 2017 Forma has raised just under Euros 400m for investment and has built a portfolio of over 20 assets. The investors in Forma’s funds are a mix of institutions, family offices and high net worth individuals.   Fladgate has acted as Forma’s main legal counsel since the commencement of the company’s UK investment programme in 2022 and, to date, has been involved in 5 acquisitions and subsequent financing and asset management activity. The buildings acquired in the UK to date have all required various degrees of active asset management, wholesale repositioning, or both.   The recent deal, led by Gideon Dabby-Joory, further diversifies Forma’s UK portfolio.  The asset acquired is majority let to Travelodge as its principal Manchester hotel and benefits from additional retail/F&B income from WM Morrison, Nando’s and Zizzi.   The project required the expertise of a team from various departments, including Real Estate, Funds, Corporate, Construction, and Tax. The team members involved were Nathan Carter-Smith, Ebru Mehmet, Neal Todd, Ellie Green, Ella Leonard and Oliver Tobin.   Chris Taylor, Forma Real Estate Funds UK CEO, commented: “The Fladgate team was a pleasure to work with. Their attention to detail identified a number of legal and title challenges which required considerable legal and commercial understanding in order to resolve and ultimately enabled us to conclude a clean purchase.”   Gideon Dabby-Joory, Real Estate Partner, added: "It was a pleasure to work again with Chris Taylor Ben Dickins and their colleagues at Forma. Authorised Push Payment Fraud (APP) reimbursement scheme – is this good news for consumers or an opportunity for fraudsters?   In an effort to combat the rise of APP, a reimbursement scheme was introduced by the Payment Systems Regulator and became mandatory on 7 October 2024.   There is concern however that the compensation scheme itself might be the victim of fraudsters.   Will Thompson and Leigh Callaway summarise the scheme & discuss what this could mean for consumers: https://lnkd.in/eyDYbNaf
