Fountain Court’s Nik Yeo has published a detailed analysis of the important crypto fraud judgment in D’Aloia v Persons Unknown & Bitkup [2024] EWHC 2342 (Ch) in the Journal of International Banking and Finance Law entitled “Crypto Exchanges: An update on D’Aloia”. In this article, Nik examines how that judgment clarifies and extends some previously established contractual and proprietary principles in relation to liability of crypto exchanges to victims of crypto fraud. Court of Appeal rejects use of global claims approach in Shell Oil spill case The appeal successfully challenged a March 2024 decision which required the Claimants to link specific damage to individual oil spills at the pleadings stage. By rejecting the use of a “global claim”, the Court of Appeal has set an important precedent, enabling claimants to bring forward complex environmental cases involving multiple pollution events without needing to prove total responsibility by a single polluter. DIFC Court refuses strike-out application and orders $242.1 million claim against auditors to proceed to 10 week trial On 27 November 2024, Chief Justice Wayne Martin in the DIFC Court of First Instance handed down judgment on an application for strike out/immediate judgment on claims brought by two entities within the Abraaj Group (which, prior to its collapse, was the largest private equity firm in the Middle East) against their former auditors, KPMG LG and KPMG LLP (two entities in the KPMG Group).
