It isn’t unusual for disputes to reach IBAS which explore principles our Adjudication Panel have never considered before. In this case study (link below) a gambling operator introduced a default net loss limit for all customers but used it as an internal monitoring tool that customers weren’t made aware of. A technical error allowed a bet to be accepted in error which took one customer over their stipulated loss limit. The operator argued that it was duty bound to void the bet, win or lose, in line with its internal safer gambling policies and obligations to adhere to the Gambling Commission’s SR codes of practice. The customer argued that the cancellation of his winnings on safer gambling grounds was unfair. https://lnkd.in/eJUw48Ry

A great deal has been written and spoken in the news in recent days about betting with ‘inside information’. IBAS clearly can’t comment on specific cases as it's possible that they may end up being the subject of a consumer dispute. However, we can signpost interested readers to the Gambling Commission’s “Misuse of Inside Information” paper published in 2018. https://lnkd.in/ez_9y6JF Pages 8-10 of the document helpfully set out the types of offences, the Gambling Commission’s regulatory view of each type of offence and, in some cases, the extent of the possible consequences.

We were delighted to be invited to speak about Generative AI, how it helps Ombudsman be more efficient and increases access to justice.
