Do you want to know more about your options for maintaining your relationship with your grandchildren? 🤔 Unlike parents, grandparents don't automatically have legal rights to see their grandchildren. This can come as a huge shock to many grandparents at an already difficult time. If a grandparent wishes to make an application to the Court to have contact with their grandchildren, permission is required from the Court before they can make an application. The Court would take into account the following when considering if permission should be given: - The applicant's connection with the child - The nature of the application - Whether the application might disrupt the child's life to the extent that they would be harmed by it- in our experience, the Court is very open-minded as to the benefits to a child to have the influence of a loving grandparent involved in their lives. Thankfully, however, Court action is not the only option: - They could discuss matters directly with the parents and see if an agreement can be reached. It is important that all parties consider matters from the point of view of the child. - Attend a mediation to see if an agreement can be reached in an amicable way. It would be helpful here if clear records could be kept and evidence gathered to demonstrate the extent of their involvement in their grandchild's life. - Instruct a Family Law Solicitor to assist them in re-establishing a relationship with their grandchild(ren). Meet Elise Wilks! Elise joined Watkins and Gunn in June 2023 as a Paralegal, but in recognition of her excellent work, she has become a Trainee Solicitor in the Employment team 💼 Elise previously worked in the non-profit sector, representing employees in Employment Tribunal cases. She now focuses on supporting Trade Union members. Elise handles claims for unfair dismissal, multi-discrimination, unlawful wage deductions, and redundancy. She holds a law degree (2021) and completed her Legal Practice Course and a Master’s in employment rights for menopausal employees in 2023. Outside of work, Elise enjoys yoga, reading, and pole fitness.
