Janet's eDiscovery Tip: Review Documents that are Not Relevant. In an eDiscovery process, reviewing documents identified as relevant is crucial for eventual production. Equally vital, however, is the diligent scrutiny of documents or categories of documents identified as not relevant. Errors can occur, and a sample review of not relevant documents, often hold key insights or identify relevant documents. As legal professionals, we cannot afford to overlook documents with a casual dismissal of "not relevant." Disclosure in litigation & arbitration must be done with eyes wide open and a proactive approach. The decision to abort the Post Office Inquiry hearing last year due to disclosure failures rang alarm bells for litigators. On 20 June 2024, the Solicitors Regulation Authority announced 20 live investigations into firms linked to the Post Office scandal, including the handling of and breaches in disclosure obligations. Clients are not enamoured by paying lawyers to review documents considered to be not relevant. However the costs may be higher if hearings are delayed due to inadequate disclosure.
