    • If you visit our website it will automatically collect some information about you and your visit, including the Internet protocol (IP) address used to connect your device to the Internet and some other information such as the pages on our site that you visit. This is used to monitor the performance of the website and improve the experience of visitors to the website.     • If you interact with us through social media services, we may be able to access certain information about such interaction, such as whether you have interacted with us through multiple social networks.     • We may make web-based platforms available to our partners, customers and suppliers and such platforms may collect your personal information if you use such platforms. This privacy policy applies to such personal information collected during the registration process and/or during the use of such platforms.
    • If you exchange emails, telephone conversations or other electronic communications with our employees and other staff members, we may record details of those conversations, sometimes including their content.
    • Some of our premises have closed circuit TV (CCTV) systems and other security and access management systems which may record you and certain information about your visit if you visit our premises or Fujitsu controlled sites, for security and safety purposes.
  • Other information: We may also collect some information from other sources. For example:
    • If we have a business relationship with the organisation that you represent, your colleagues or other business contacts may give us information about you such as your contact details or details of your role and interactions with us.
    • We sometimes collect information from third party data providers or publicly available sources for anti-money-laundering, export control, credit rating background checking and similar purposes, and to protect our business and comply with our legal and regulatory obligations.
    • If Fujitsu acquires or merges with another company, we will process your personal information that is provided to us by the company that Fujitsu has acquired or merged with, subject to applicable local laws.
    • Our website may contain links to websites of third parties who are not affiliated to Fujitsu. If you access such third party websites by clicking on such links, we are not responsible for the way in which such third parties process your personal information that they collect.

Sensitive Information

We request that you do not send or share with us any sensitive personal information (e.g. information related to racial or ethnic origin, political opinions, religion or other beliefs, health, sexual orientation, genetics, or biometric data, criminal background or trade union membership or any other personal information that may be considered sensitive).

There may be limited situations where we do request strictly necessary sensitive personal information from you, for example when we are undertaking due diligence and compliance checks on a supplier. Use of your personal information

This may include reviews for the purposes of disclosure of information relevant to litigation and/or reviews of records relevant to internal or external regulatory or criminal investigations. To the extent permitted by applicable law, these reviews will be conducted in a reasonable and proportionate way and approved at an appropriate level of management. Our data security and retention policies

The security, integrity and confidentiality of your personal information is extremely important to us. We have implemented technical, administrative, and physical security measures that are designed to protect your personal information from unauthorized access, disclosure, use and modification. We regularly review our security procedures to consider appropriate new technology and methods to protect information we hold.

We will delete your personal information when we no longer need such personal information, for instance where:

  • it is no longer necessary for us to retain your personal information to fulfil the purposes for which we had collected it;
  • we believe that your personal information that we hold is inaccurate; or

Sometimes, however:

Personal Information of Children and/or vulnerable individuals

Fujitsu respects the privacy of children (and/or vulnerable individuals) and does not knowingly collect, use or disclose personal information of children (as defined under local law) or vulnerable individuals without verifiable consent from a parent or guardian.

Legal Basis of Personal Information Processing

Under the Personal Information Protection Law (PIPL) and other data protection laws and regulations in China, we will process your personal information based on your consent unless your personal information is:

  • necessary to conclude or perform a contract in which you are a party;
  • necessary for us to comply with legal obligations;
  • necessary to respond to public health emergencies;
  • necessary to protect individuals’ life, health, and property safety;
  • reasonably processed in news reporting and public opinion oversight for public interests; and
  • publicly available because of your voluntary disclosure or a legal requirement and reasonably processed.

Consent Management

If we process your personal information that requires separate consent specified by laws or regulations, or for other purposes not described in this privacy policy, we will inform you in a reasonable manner and obtain your consent before processing.

You may withdraw your consent to us for not processing your personal information. Upon your request, we will delete your personal information and cease to process unless otherwise specified by laws and regulations. Sensitive Personal Information

Sensitive personal information is personal information that may materially impact your rights and interests if breached or unlawfully used, including but not limited to financial accounts, national identification numbers, health-related information, or any personal information of minors under the age of fourteen.

If we would like to process any of your sensitive personal information, we will obtain your consent or fulfil exempted circumstances under laws and regulations, informing you of the necessity of processing your sensitive personal information and its impact on your rights and interests. Disclosure and Sharing of Personal Information

In principle, we will only disclose or share your personal information where reasonably necessary for the purposes set out within the global privacy policy.

If disclosure or sharing of your personal information is necessary, we will inform you of the purpose of disclosure or sharing, the type of personal information involved, information of the personal information recipient(s), and the method of personal information processing before the disclosure or sharing. Disclosure or sharing will only be initiated after obtaining your consent unless otherwise specified by laws and regulations. If the disclosure or sharing circumstances change, we will inform you and re-obtain your separate consent.

Cross-border Data Transfer

If we transfer your personal information to any overseas third parties outside of China, we will inform you of the purpose of the transfer, the type of personal information involved, information of the overseas recipient(s), and the method of processing before the transfer. The transfer will be initiated after obtaining your consent unless otherwise specified by laws and regulations, and we will ensure our arrangement complies with the cross-border data transfer legal mechanisms to protect your personal information.

Personal Information of Children

In the case of collecting children’s (under the age of 18) personal information with parental consent, we will only process such information in the circumstances as permitted by laws and regulations, with the explicit consent of parents or guardians, or with the need to protect children. If we find that we have collected children’s personal information without prior verifiable parental consent, the data will be deleted as soon as possible.

India

Sharing of personal information without your consent:

The information shared by you including your sensitive personal information can be shared without obtaining your prior consent, with Government agencies mandated under the law to obtain personal information including sensitive personal information for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution and punishment of offences.

Any personal information or sensitive personal information may be disclosed to any third-party by an order under the law for the time being in force.

Transfer of personal information:

We may transfer your personal information including your sensitive personal information to any other body corporate or a person located in India or outside India, that ensures the same level of data protection that is adhered to by them as provided under the local law and regulations.

Such transfer may only take place if it is necessary for the performance of the lawful contract between the body corporate or any person on its behalf and provider of information or where you have consented to such transfer.

Provided, that we shall not be responsible for the authenticity of the personal information or sensitive personal information supplied by you or provider of information to us or any other person acting on behalf of us.

Where we have requested your sensitive personal information for the purpose of providing specific services or goods and you have withdrawn your consent to the such processing of such sensitive personal information, we may discontinue to provide you the specific services or goods further for which the information was sought.

Your duty as provider of information:

  • You shall comply with all applicable laws for the time being in force while exercising rights under the provisions of local laws or this privacy policy.
  • You shall ensure not to impersonate another person while providing personal information including sensitive personal information for a specified purpose.
  • You shall not suppress any material information while providing personal information including sensitive personal information for any document, unique identifier, proof of identity or proof of address.
  • You shall only furnish such information as is verifiably authentic while exercising the right to correction or erasure.

Indonesia

Rights of Personal Data Subjects

If you are subject to Indonesian law, you possess the following rights in addition to those mentioned above:

  • to obtain information about identity, legal basis, purpose of requesting and using personal data, and accountability of the party requesting personal data.
  • to withdraw your consent given to us for processing your personal data. We will cease processing your personal data within 3 × 24 hours.

Please be aware that your rights may be subject to exceptions, particularly concerning specific interests such as national defence and security, law enforcement, public interest, supervision of financial sectors, statistics, and scientific research according to the relevant personal data protection law and regulations in Indonesia.

Data Transfers

We are committed to implementing the necessary safeguards and measures to protect your personal data in accordance with personal data protection laws and regulations during international transfers. If these criteria are not met, your prior consent is required.

Retention of Personal Data

Your personal data stored on our website and other systems will be retained for a minimum period of 5 years, unless specific laws and regulations dictate a different retention period.

This information is used for the purpose of evaluating your application, conducting background checks (where legally permissible), and managing the recruitment process.

By submitting your application, you consent to the processing of your personal data for such purposes, as well as any additional purposes outlined in this Privacy Policy. Malaysia

Consent

When you access our website, request information or sign up for our products and/or services or when you enter into any commercial transactions with us, you may be required to provide us with your personal information. In doing so, you consent to the use or processing of your personal information by us in accordance with this privacy policy.

Withdrawal of Consent

If you wish to withdraw consent, you should give us reasonable advance notice. We will advise you of the likely consequences of your withdrawal of consent (e.g., we may not be able to continue providing you with the product and/or services or keep you informed with the new offering launches).

Transferring of Personal Information

It is deemed that you consent and agree to Fujitsu transferring your personal information outside of Malaysia for any of the purposes as listed under the section “Disclosure and international transfer of your personal information” above.

Exercising Your Rights to Access Information

You may write in to us to request access to your personal information. Before we accede to your request, we may need to verify your identity by checking your NRIC or other legal identification document. We will respond to your request as soon as possible, or within 21 days from the date we receive your request. If we are unable to do so within the 21 days, we will let you know and give you an estimate of how much longer we require. We may also charge you a reasonable fee for the cost involved in processing your access request.

New Zealand

Fujitsu will only transfer personal information to another organisation outside New Zealand if the receiving organisation will adequately protect the information or is subject to privacy laws that, overall, provide comparable safeguards to the New Zealand Privacy Act 2020 or with your permission. Philippines

You have the following right in relation to the personal information that we hold about you:

  • to be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your personal data.

Singapore

Collection, Use, Disclosure

Before we collect, use or disclose your personal information, we will notify you of the purpose why we are doing so. We will obtain consent from you, unless exceptions to consent under the Singapore Persona Data Protection Act 2012 apply. We will only process your personal information for the purposes stated above.

Accuracy of Personal Data

We will take reasonable steps to ensure that the personal information we collect about you is accurate, complete and kept up to date. It is important that you update us of any changes to your personal information (such as a change in your mailing address). From time to time, we may do a data verification exercise for you to update us on any changes to the personal information we hold about you.

Withdrawal of Consent

If you wish to withdraw consent, you should give us reasonable advance notice. We will advise you of the likely consequences of your withdrawal of consent, e.g. without your personal contact information we may not be able to contact you to keep you informed of our forthcoming events or new product launches. Exercising Your Rights

Thailand

You have the following rights (subject to applicable local laws) in relation to the personal information that we hold about you:

Right to access and obtain copy

You have the right to access and obtain copy of your personal data held by us, unless Fujitsu is entitled to reject your request under the laws or court orders, or if such request will adversely affect the rights and freedoms of other individuals.

Right to rectification

You have the right to rectify your inaccurate personal data and to update your incomplete personal data to make it accurate, up-to-date, complete and not misleading.

Right to erasure

You have the right to request us to delete, destroy or anonymise your personal data, unless there are certain circumstances where Fujitsu has the legal grounds to reject your request.

Right to restrict

You have the right to request us to restrict the use of your personal data under certain circumstances, e.g. when Fujitsu is pending an examination process in accordance with your request to rectify your personal data or to object to the collection, use or disclosure of your personal data, or you request to restrict the use of personal data instead of the deletion or destruction of personal data which is no longer necessary.

Right to object

You have the right to object to the collection, use or disclosure of your personal data in case Fujitsu proceeds with legitimate interests basis or for the purpose of direct marketing, or for the purpose of scientific, historical or statistic research, unless Fujitsu has legitimate grounds to reject your request. For instance, Fujitsu has compelling legitimate grounds to collect, use or disclose your personal data, or the collection, use or disclosure of your personal data is carried out for the establishment, compliance, or exercise legal claims, or for the reason of our public interests.

Right to data portability

You have the right to receive your personal data in case Fujitsu can arrange such personal data to be in the format which is readable or commonly used by ways of automatic tools or equipment and can be used or disclosed by automated means. Also, you have the right to request us to send or transfer your personal data to a third party, or to receive your personal data which Fujitsu sent or transferred to the third party, unless it is impossible to do so due to technical circumstances, or because Fujitsu exercises its legitimate right to reject your request.

Right to withdraw consent

You have the right to withdraw your consent that has been given to us at any time pursuant to the methods and means prescribed by us, unless the nature of consent does not allow such withdrawal.

Right to lodge a complaint

You have the right to make a complaint with the Personal Data Protection Committee or their office if Fujitsu does not comply with the PDPA. The right to know

Data subjects are entitled to know information on the processing of their personal data, unless otherwise provided for by law.

Data subjects are entitled to consent or refuse to consent to the processing of their personal data, except the case specified in the laws.

The right to access

Data subjects are entitled to file complaints or denunciations or initiate lawsuits in accordance with law.

The right to claim compensation for damage

Processing of personal data of children

For the processing of personal data of a child, it is required to obtain the consent of such child, in case the child is full 7 years old or older, and the consent of the child’s parent or guardian under regulations. We shall verify the age of children before processing their personal data.

For certain processing, including but not limited to, direct marketing activities, we will rely on your consent. If we rely on your consent, such consent will be clear, freely given, genuine and you will be able to withdraw your consent at any time.

EU and UK

EU/UK Lawful basis for processing

We will only process your personal information as necessary so that we can pursue the purposes described in this privacy policy and where we have a legal basis for such processing. Where our lawful basis for processing is that such processing is necessary to pursue our legitimate interests, we will only process your personal information where we have concluded that our processing does not prejudice you or your privacy in a way that would override our legitimate interest. In exceptional circumstances we may also be required by law to disclose or otherwise process your personal information.

EU/UK Data Transfers Addition

In those cases, where we transfer your personal information to other members of the Fujitsu group, our service providers or partners, we will ensure that our arrangements with them are governed by relevant legal mechanisms and safeguards including data transfer agreements, designed to ensure that your personal information is protected and in compliance with applicable law.
