The AIRE Centre is a specialist non-governmental organisation that provides expertise and practical advice on European Union and Council of Europe legal standards and has particular experience in litigation before the European Court of Human Rights , where it has participated in over 150 cases. For twenty years now, the AIRE Centre has built an unparalleled reputation in the Western Balkans, operating at all levels of the region’s justice systems. It works in close cooperation with ministries of justice, judicial training centres and constitutional and supreme courts to lead, support and assist long term rule of law development and reform projects. The AIRE Centre also cooperates with the NGO sector across the region to help foster legal reform and respect for fundamental rights.

  • Valentina Pavličić danas je izabrana za predsjednicu Vrhovnog suda Crne Gore! Svojim angažmanom i ekspertizom, Pavličić je dala značajan doprinos zaštiti ljudskih prava i usklađivanju rada crnogorskog pravosuđa sa evropskim standardima. AIRE centar s ponosom ističe dugogodišnju saradnju sa sutkinjom Pavličić, koja je kroz niz zajedničkih projekata doprinijela unapređenju sudskih praksi i edukaciji pravosudnih stručnjaka i praktičara širom regiona. Njena predanost međuinstitucionalnom i međunarodnom povezivanju dodatno je osnažila pravosudni sistem Crne Gore. Posebno se istakla u oblasti edukacije, gdje je aktivno radila na osnaživanju pravosudnih stručnjaka kroz programe obuke o međunarodnim standardima i praksi Evropskog suda za ljudska prava. Njena profesionalna karijera obuhvata niz ključnih funkcija unutar crnogorskog pravosuđa i šire. Između ostalog, Valentina Pavličić je obavljala dužnost Zastupnice Crne Gore pred Evropskim sudom za ljudska prava, predsjednice Krivičnog odjeljenja Višeg suda u Podgorici, te sutkinje Specijalnog odjeljenja za organizovani kriminal, korupciju, terorizam i ratne zločine Višeg suda u Podgorici. “Valentina Pavličić je zaslužila ovo poverenje svojom nepokolebljivom posvećenošću pravdi, integritetu i nepristrasnosti. Kao odlučna i iskusna liderka, dokazala je spremnost da se suoči sa izazovima u jačanju vladavine prava. Njena predanost izvrsnosti, etičkim standardima i zaštiti ljudskih prava čini je uzorom u crnogorskom pravosuđu. Čast mi je, ispred AIRE centra, da uputim iskrene čestitke povodom njenog imenovanja na ovu važnu poziciju.     Organizovani kriminal ne poznaje granice, a ilegalni tokovi novca ozbiljno podrivaju rad institucija, ugrožavaju društvo, onemogućavaju ekonomski napredak, te predstavljaju prijetnju sigurnosti. Prepoznajući važnost efikasnog procesuiranja ovih krivičnih djela, AIRE centar je u saradnji sa Centar za obuku u sudstvu i državnom tužilaštvu održao stručnu obuku na temu „Pranje novca – izazovi u praksi“ za sudije i tužioce Crne Gore. 🇲🇪 ⚖️ Kroz multidisciplinarni pristup i razmjenu iskustava pravosudnih praktičara iz Crne Gore, u okviru ove edukacije razmatrani su ključni izazovi u otkrivanju i procesuiranju pranja novca. Poseban fokus stavljen je na: ✅ Normativni okvir i značaj definisanja kriminalne djelatnosti, o čemu je govorila sutkinja Vesna Kovačević ✅ Praksu Vrhovnog državnog tužilaštva i važnost međusektorske i međunarodne saradnje, o čemu je govorila tužiteljka Lidija Vukčević ✅ Uporednu praksu i standarde u regionu, o čemu su govorili profesor Eldan Mujanović i tužiteljka Gordana Krstić 🗣 „Pravosuđe treba da kontinuirano prati sve trendove pranja novca, te unaprjeđuje sudsku praksu i prihvata međunarodne standarde, kako bi se povećao broj uspješno procesuiranih slučajeva i efektivnije oduzimala nezakonita dobit. Jedna ovakva multidisciplinarna obuka definitivno može biti korisna pravosudnim djelatnicima Crne Gore da steknu nova i poboljšaju postojeća znanja", poručio je Eldan Mujanović. 🗣 „Pranje novca, pored organizovanog kriminala, terorizma, korupcije i visokotehnološkog kriminala, predstavlja najtežu, najsloženiju vrstu kriminalnih aktivnosti, koja egzistira u svim sferama savremenog društva i konstantno preti da ugrozi nacionalni demokratski poredak, državnu bezbednost, stabilnost privrednog i finansijskog sektora i slobode i prava građana", kazala je Gordana Krstic. 🤝 Edukacije je održana zahvaljujući podršci Vlade Ujedinjenog Kraljevstva.

    📢 Today marks the International Day for the Elimination of Violence Against Women, and the beginning of the 16 Days of Activism against Gender-Based Violence.  One year ago, we launched two crucial publications that remain significant resources for research and effective tools for improving the prosecution of GBV and femicide ➡️ https://lnkd.in/dv6M_9ny 📘 Judicial Response to Femicide in the Western Balkans: Legal Framework and Judicial Practice   📘 Guidelines on Addressing Femicide Cases: The Handbook for the Judiciary Since their launch, these documents have been promoted throughout the Western Balkans, reaching over 200 judges, prosecutors, lawyers, and judicial experts in Albania, Bosnia and Herzegovina, Kosovo, Montenegro, North Macedonia, and Serbia. While much work remains, we are encouraged by signs of improvement in sentencing practices for femicide and GBV, as well as swift actions in detecting and preventing femicides. With the support of the Gender Champions in the Judiciary Network – the only network of its kind in Europe uniting judges to address gender-based crimes – we have strengthened links, collaboration, and the exchange of best practices among judges and legal practitioners in the region. Reflecting on the symbolism of this day, we are immensely grateful our #GenderChampions, for their dedication as advocates and strong voices in this effort.  On the ground, our partnerships with local NGOs across the Western Balkans help us monitor femicide and gender-based violence cases, providing us with insights into what happens beyond courtroom doors, and ensuring no voice goes unheard. That effort is possible thanks to our partners, FemPlatz from 🇷🇸,  Human Rights in Democracy Centre from 🇦🇱, Centre of Women’s Rights from 🇧🇦, Women’s Rights Centre from 🇲🇪, Kosovo Law Institute from 🇽🇰, National Network to End Violence Against Women and Domestic Violence from 🇲🇰, and Victimology Society from 🇷🇸. Through collaboration with judicial training institutions, we work with key experts to deliver training programs that foster the exchange of knowledge, skills, and ideas on gender equality among judges and legal practitioners. Research remains at the core of our efforts, as we continuously explore new avenues to address gender-based violence and advocate for systemic change. Our work is guided by the evolving practice of the European Court of Human Rights, and we are deeply grateful to its former and current judges for their valuable contributions to our training and discussions.  All of these efforts are made possible thanks to the support from the Government of the United Kingdom, and the immense work and contributions from British embassies of the Western Balkans countries. Together with our partners, we remain committed on the path of ensuring accountability, justice, improved prosecutions, and better prevention of  violence against women.

    As COP 29 takes centre stage, the connection between human rights and environmental protection has never been more critical — or urgent. Environmental harm is not just an ecological issue; it strikes at the core of fundamental rights, from health to property and even life itself. We are delighted to share Human Rights and Environmental Protection in Europe: Case law from the European Court of Human Rights and its Implications, prepared by The AIRE Centre Western Balkans in partnership with Sustineri Partners. Authored by William Ferris, with contributions from Biljana Braithwaite, Catharina Harby, Nevena Dicic Kostic, and Azra Becirovic, this guide explores how the European Convention on Human Rights (ECHR) is being applied to tackle pressing challenges like pollution, climate change, and biodiversity loss. This work is particularly relevant in the Western Balkans, a region rich in natural resources but highly vulnerable to environmental degradation. Designed as a resource for policymakers, legal professionals, and activists, it offers actionable insights that can drive meaningful change. Key sections of the guide analyse how various articles of the ECHR — including the right to life, health, privacy, and property — are applied to mitigate environmental threats. Notably, it includes an examination of the 2024 judgement in Verein KlimaSeniorinnen Schweiz and Others v. Switzerland, which potentially sets a new precedent for the Court’s approach to climate obligations. At a time of uncertainty and inconsistency in how courts are approaching environmental cases, this guide provides a map of relevant European standards that guide judicial actors on the path of protection of human rights and environment.   • The AIRE Centre is proud to have partnered with the Digital Forensics Conference! ⚖️ We brought together prosecutors from Albania, Bosnia and Herzegovina, and Serbia to engage in discussions on cybercrime, digital forensics, and cybersecurity. Organised by the Archibald Initiative, this conference provided a valuable platform to share knowledge and equip participants with the tools needed to tackle the evolving challenges facing the Western Balkans. Why is this important for prosecutors in the region? ❗ Prosecutors are at the frontline of combating crimes increasingly facilitated by technology. The forum highlighted how advancements in artificial intelligence and blockchain are being misused for fraudulent activities, blackmail, and laundering money. We delved into the dual role of technology—how it facilitates crime but also serves as a powerful tool for its investigation 👇 ➡️ The misuse of AI in orchestrating financial fraud and exploitation.  ➡️ How blockchain analytics can trace illicit money laundering activities.  ➡️ Emerging technologies that assist in the detection, investigation, and recovery of assets tied to organised crime. 🤝 Congratulations to Stanoje Rnic and the conference team for a highly impactful event!

  • Pozdrav iz Sarajeva! 🇧🇦 Ustavni sud BiH i AIRE centar, u saradnji sa Centrom za edukaciju sudija i tužitelja FBiH, te uz podršku Vlade Ujedinjenog Kraljevstva, predstavili su novu publikaciju "Analiza prakse tužilaštava u BiH u predmetima organizovanog kriminala i korupcije". ⚖️ Događaju su prisustvovali tužitelji Tužilaštava BiH, Federalnog tužilaštva Federacije BiH, kantonalnih tužilaštava Kantona Sarajevo i Zeničko-dobojskog kantona, te Okružnog javnog tužilaštva u Istočnom Sarajevu. 🗣️ Zlatko M. Knežević, bivši predsjednik Ustavnog suda Bosne i Hercegovine i konsultant na projektima AIRE centra, Samir Selimović, tužitelj Kantonalnog tužilaštva Kantona Sarajevo, i Zvonko Mijan, konsultant na projektima AIRE centra, ukazali na glavne nalaze ove publikacije. Analiza pruža detaljan uvid u metode koje tužilaštva koriste u suočavanju s izazovima organizovanog kriminala i korupcije, sa fokusom na teška krivična djela kao što su trgovina drogom, porezna utaja i pranje novca, ali i slučajeve visoke korupcije poput zloupotrebe položaja i primanja mita. 👉 Analiza također prepoznaje nove izazove savremenog doba, kao što su digitalni novac, vještačka inteligencija i kriptirane komunikacije, ukazujući na potrebu za daljim unapređenjem pravosudnih kapaciteta. 🗣 „Ono što ovo istraživanje izdvaja u odnosnu na ranija je što je samim tužiocima omogućena prilika da pruže neposredan uvid u pravosudnu borbu protiv organizovanog kriminala i korupcije, odnosno da predstave praksu i probleme s kojima se suočavaju u procesuiranju ovih predmeta, te da predlože sistemske promjene koje je neophodno napraviti“, kazao je sudija Zlatko M.   • 📢 U okviru obilježavanja 60 godina postojanja Ustavnog suda Crne Gore, predstavljena je publikacija "Ljudska prava i zaštita životne sredine u Evropi: Pregled sudske prakse Evropskog suda za ljudska prava", koju je izradio AIRE centar u saradnji sa Sustineri Partners. 👉 Ovaj vodič sadrži analizu kako se različiti članovi Evropske konvencije o ljudskim pravima — poput prava na život, zdravlje, privatnost i imovinu — primjenjuju za rješavanje različitih prijetnji po životnu sredinu, uključujući klimatske promjene, zagađenje, degradaciju zemljišta i gubitak biodiverziteta. ⚖️ Tokom konferencije, posebna pažnja posvećena je pitanju prava na zdravu životnu sredinu. O ovoj, ali i drugim temama važnim za djelovanje ustavnih sudova, govorili su Mladen Vukčević, bivši predsjednik Ustavnog suda Crne Gore, Zlatko Knežević, bivši predsjednik Ustavnog suda Bosne i Hercegovine, te Biljana Braithwaite, direktorka Programa za Zapadni Balkan AIRE centra. 🗣️ Biljana Braithwaite je kazala da: „Pravna načela uspostavljena Evropskom konvencijom o ljudskim pravima i praksom Evropskog suda za ljudska prava u ovom polju dobijaju sve veći značaj na Zapadnom Balkanu.
