One year after the Supreme Court's decision in Sackett v. EPA, confusion still surrounds its impact on economic development projects like construction, infrastructure, and agriculture. Balch’s Bradley Ennis and Susan Stutts note that while the ruling provided a clearer test for defining "Waters of the United States" (WOTUS), the interpretation and application of that test remain uncertain. Federal agencies like the EPA and Corps of Engineers, along with some courts, are still navigating the complexities of the decision.
