Congratulations to Orlando Partner Therese Savona, who was recently appointed by the Chief Judge of the Eleventh Circuit Court of Appeals to serve on the appellate court's Committee on Lawyer Qualifications and Conduct. Ms. Savona was also appointed to serve as the Chairman of the Committee's Florida Investigative Panel. The work of the committee assists the Chief Judge in providing recommendations regarding disciplinary and/or competency concerns received by the Chief Judge or the Court's disciplinary panel. CSK West Palm Beach Partner/Director of Professional Development, Rochelle Chiocca, and CSK Orlando Partner, Brian Fery, enjoyed networking with the students and introducing them to our firm.  While in Gainesville, Rochelle and Brian also had the pleasure of being joined for dinner by some of the UF students who will be working at CSK this summer or fall.  

Tampa Partners Dan Shapiro and Marina Moussa recently received fantastic verdict in Hillsborough County. The carrier had previously tried to tender its limits, and after the tender was rejected, sent the file to CSK for handling. This was an admitted liability case with minor damage to both vehicles. Plaintiff had a history of prior treatments but was seemingly asymptomatic for 4 years prior to the accident. After the accident, Plaintiff immediately presented to MedExpress and then the hospital. Within three months he underwent major back surgery and later continued treatment. Plaintiff's bills were over $300,000. Dan and Marina were able to successfully show that this was not an acute injury but rather a degenerative condition that was not related to the accident. Plaintiff did not ask for a specific total in trial, but it was clear that they were requesting more than a million dollars. After deliberating for four and a half hours, the jury returned a verdict of $23,000 and found no permanency. Orlando Partner Justin L. Seekamp recently obtained a summary judgment and final judgment in favor of an insurance company against a breach of contract claim for Personal Injury Protection benefits from a medical provider in Miami-Dade County. Among other successful defenses, Justin was successfully able to argue that no additional PIP benefits were due and owing under the terms of the applicable policy to the medical provider and successfully opposed arguments raised by the medical providers counsel that AMICA's policy was "ambiguous," that AMICA improperly issued payments to other medical providers above the "permissive fee schedule," and that AMICA issued payments to another medical provider whose bills were "untimely" finding that Plaintiff had shown no evidence that the medical providers bills were not timely postmarked.
